RESOLUTION NO. 89-211
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
APPROPRIATION LIMIT AS REQUIRED BY ARTICLE XIIIB OF THE CALIFORNIA STATE CONSTITUTION AND STATE LAW
WHEREAS, Article XIIIB of the California State Constitution require
that governments annually establish a limit on the appropriation o
proceeds of taxes; and
CARLSBAD, CALIFORNIA, ESTABLISHING THE 1989-90

NOW, THEREFORE, BE IT -RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the City Council of the City of Carlsbad, California, does
hereby establish and adopt the 1989-90 appropriation 1 imit of Forty
million, one hundred twenty thousand, one hundred and ninety-four dollars
($40,120,194) as computed in Exhibit E attached hereto.

Gann Limit - ADProPriations Subject to Limit
In 1979, Proposition 4, the "Gann" initiative, was passed, The purpose of t law is to limit government spending by putting a cap on the total proceeds
taxes that may be appropriated each year. This 1 imit is increased each y through a formula that takes into consideration changes in the Consumer Pr
Index and state per-capita income. When a city reaches this 1 imi t, excess revenue must be returned to the State or citizens through a process of refun! rebates, or other means that may be defined at that time. The Gann limit the City of Carlsbad has increased steadily since 1979 and still provides City with a comfortable operating margin. The spending limit for the City Carlsbad for 1989-90 is $40.1 million, with appropriations of "proceeds taxes'' of only $30.5 million. This allows the City a margin of $9.1 millio
