A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DENYING AN APPEAL AND
UPHOLDING A PLANNING COMMISSION DECISION TO APPROVE
A TENTATIVE TRACT, PLANNED UNIT DEVELOPMENT, STANDARDS VARIANCE AND A SPECIAL USE PERMIT TO CONSTRUCT 42 TOWNHOME CONDOMINIUMS SOUTH OF PARK DRIVE AND EAST OF MARINA DRIVE IN THE PC ZONE, WITHOUT ADDITIONAL CONDITIONS REQUESTED BY THE APPELLANT. CT 89-13/PUD 89-5/SUP 89-7/SV 89-3 - THE HAMPTONS (APPEAL)
WHEREAS, on February 17, 1990 and February 21, 1990,
Carlsbad Planning Commission considered a request for approva:
CT 89-13/PUD 89-5/SUP 89-7/SV 89-3, subject to additic
conditions requested by neighboring residents: and
WHEREAS, the Carlsbad Planning Commission apprc
Tentative Map 89-13, Planned Development 89-5, Standards Variz
89-3 and Special Use Permit 89-7 without said additic
conditions: and
WHEREAS, the City Council of the City of Carlsbad, on Mz
27, 1990 considered an appeal of the Planning Commission decis
to approve CT 89-13/PUD 89-5/SUP 89-7 and SV 89-3 without E
additional conditions: and
WHEREAS, upon considering the request, the City Cour
considered all input including staff reports and public testin
from two Planning Commission hearings and one City Cour
hearing relating to the Tentative Map, Planned Developmc
Standards Variance, Special Use Permit, and appeal thereof
include the appellant's requested conditions: and
WHEREAS, the appellant's requested additional conditi
would not further the project's compliance with the Gene
Plan, applicable Local Coastal Program, and Zoning Ordinancl

1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Cour

of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.

That the findings of the Planning Commission in Resolut
Nos. 2982, 2983, 2984, 2985 and 2986, on file with the C Clerk and incorporated herein by reference, constitute findings of the City Council in this matter and that
other findings are required or necessary.
That CT 89-13/PUD 89-5/SUP 89-7/SV 89-3 is approved subj to all conditions of Planning Commission Resolution N
2982, 2983, 2984, 2985, and 2986.
That the ridge height of all structures shall not exceed feet .
