RESOLUTION NO. 9 0 - 3 16
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE MEMORANDUM OF
UNDERSTANDING WITH THE CARLSBAD POLICE OFFICERS’
ASSOCIATION.
WHEREAS, the City Council adopted Resolution No. 90-265 approving a
Memorandum of Understanding between representatives of Management and thc
7 Carlsbad Police Officers’ Association on August 7, 1990; and
8 WHEREAS, it has been determined, by both parties, that it is necessary tc
9 amend this Memorandum of Understanding to correct ARTICLE 32. VACATION 1
lo 11 reflect the vacation accrual schedule which became effective as of July 1, 1989,
11
12 outlined in Exhibit A; and
13 11 WHEREAS, it has been determined, by both parties, that it is necessary to
14
negotiation of the MOU, authorizing the City to initiate the amendment to the C 15
amend ARTICLE 24. RETIREMENT BENEFITS to include a clause as agreed upor
contract with the Public Employees’ Retirement System to provide the Military I-6
l7 (1 Service Credit Option, as outlined in Exhibit B.

19 I) I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
20 Carlsbad, California, as follows:

3. There is no immediate fiscal impact associated with the aforementionec

ARTICLE 24. RETIREMENT BENEFITS
24.1 The City agrees to continue to pay the employefs contribution rate
required by the Public Employees’ Retirement System to maintain the
current level of benefits for employees covered by this Memorandum (
Understanding during the term of this Memorandum of Understanding
24.2 The City will continue to pay on behalf of all sworn represented safet
employees the nine percent (9%) employees’s retirement contribution
to PERS.
24.3 The City will continue to pay on behalf of all represented
miscellaneous employees the seven percent (7%) employee’s retireme1
contribution to PERS.
24.4 As soon as practical following the execution of this Agreement, the
City shall undertake to amend its contract with the Public Employees’
Retirement System to include the Military Service Credit Option,
thereby providing to each employee the option to “buy back“ prior
military service; in accordance with the provisions of Section 20930.3
of the California Government Code.
