RESOLUTION NO. 91-247
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, EXPRESSING ITS INTENT
TO INITIATE PROCEEDINGS PURSUANT TO CHAPTER
11.08 OF THE CARLSBAD MUNICIPAL CODE AND CALLING A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY, OR WELFARE REQUIRE
THE FORMATION OF AN UNDERGROUND UTILITY
DISTRICT ON PORTIONS OF TAMARACK AVENUE FROM
1-5 TO CARLSBAD BOULEVARD.
WHEREAS, Chapter 11.08 of the Carlsbad Municipal
provides for the formation in the City of Carlsbad of undergi
utility districts to accomplish the orderly removal of exi:
overhead facilities and the construction of new underg;
facilities; and
WHEREAS, the City staff has consulted with the affc
utilities and has conducted preliminary studies and
investigations ccncerning the feasibility of such a district
area generally on Tamarack Avenue from Carlsbad Boulevard to
WHEREAS, said studies and investigations indicate
further proceedings pursuant to Chapter 11.08 are warrantc
determine whether or not the district should be established;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The Council hereby expresses its intent to ini
proceedings for the formation of an underground utility dis
for the above-described area to be known as Underground Ut
District No. 13.

2, NOTICE IS HEREBY GIVEN that a public hei
will be held by the City Council of the City of Carlsba
September 3,1991, at the hour of 6:OO p.m. in the Council Char
of the City Hall, Carlsbad, California, to ascertain whethei
public health, safety, or welfare require the removal of p(
overhead wires, and associated overhead structures, and
underground installation of wires and facilities for supp:
electric, communication or similar associated service in the
hereinabove described and to determine whether or not the

utilities at least fifteen (15) days prior to the date therec
PASSED, APPROVED AND ADOPTED at a regular meeting 0:
