RESOLUTION NO. 91-400
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA, ORDERING CHANGES AND MODIFICATIONS IN PROCEEDING! AND ASSESSMENTS IN A SPECIAL ASSESSMENT DISTRICT
WHEREAS, the City Council of the City of Carlsbad has pre
adopted its Resolution of Intention and confirmed an assessment for certai
of improvement in a special assessment district, pursuant to the te
provisions of the "Municipal Improvement Act of 1913", being Division 1;
Streets and Highways Code of the State of California; said special ass
district known and designated as Assessment District No. 86-1 (Palomar
Road), hereinafter referred to as the "Assessment District"; and,
WHEREAS, subsequent to the confirmation of the assessment ar
the improvements were ordered, but during the pendency of these proceedi
appears to be in the best public interest to order certain cham
modifications to the proceedings, the Engineer's "Report" and the II
improvement.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and correct.
2. That it is hereby ordered that certain specific chan
modifications be made, said changes and modifications generally desci
follows:
A. Mitigation repair and replacement including weeding, p
irrigation repair and fertilizing, cultivating or as
work as required.
Slope erosion control including raking, hydroseeding,
jute matting and hay bales.
Annual monitoring and reporting for a five-year peri

D. Annual maintenance including replanting, weeding, fertil
and associated work as needed for a five-year period.
The estimated cost for the referenced changes in work is as f 3.

That said changes and modifications are hereby ordered purs
the provisions of Section 10352 of the Streets and Highways Code and said
and modifications will not result in the increase in any individual ass
or result in the inclusion of any properties not originally within the bo1
of the Assessment District.

modifications inasrnuch as said modifications meet the intent and require1
