A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND
THF RFGFNTS OF THF UNlVFRSlTY OF CAI IFORNIA
The City Council of the City of Carlsbad, California does hereby resolve as follows:
1. That certain agreement between the City of Carlsbad and the Regents of the Univer
California for paramedic training, attached hereto as Exhibit A, is hereby approved. 7

AFFILIATION AGREEMENT BETWEEN THE REGENTS OF THE UNIVERSITY OF CALIFORNIA
AND CARLSBAD FIRE DEPARTMENT CONCERNING .TRAINING OF EMT-P STUDENTS
THIS AGREEMENTl made and entered into this day of I
1991, by and between The Regents of the University of California on behalf of UCSD Medical Center's Department of Emergency Medical Services (vlUNIVERSITYvl) and CARLSBAD FIRE DEPARTMENT (vvAGENCYgl) with reference to the following facts;
WITNESSES
WHEREAS, AGENCY has need to train AGENCY personnel in compliance with the provisions of California State Health Safety Code, 1481.1, and the Department of Transportation, National Highway Traffic Safety Administration, National Training course;
and
WHEREAS, UNIVERSITY is certified to instruct a paramedic training course as required by AGENCY and possesses facilities and
qualified professional personnel to provide such training
( It PROGRAMv1 ) ; and,
WHEREAS, it is to the mutual benefit of both parties that
AGENCY personnel designated as paramedic students (llSTUDENTSvl)
obtain their training at UNIVERSITY.
THEREFORE, it is agreed:
1. BOTH PARTIES SHALL:
A. Acknowledge that all schedules and time frames are approximate as the core training is a competency-based learning experience in which STUDENTS do not progress
from one phase to the next until competency has been
demonstrated in each phase of the course. Additional supervised tutoring in any of the three phases described in Paragraph 2. B. may be required at any time by the
teaching staff, including weekends, evenings, and
holidays .
B. Insure that STUDENTS comply with UNIVERSITY'S "EMS Training Paramedic Performance Standardst1 described in Exhibit A attached hereto and incorporated herein by this reference.
C. Recognize that it is not possible for STUDENTS to enter into PROGRAM after initial orientation due to the accelerated rate involved.

D, Maintain any records developed by the parties and related to this Agreement for a period of four (4) years following the completion of this Agreement.
E. Insure that selection and placement of STUDENTS shall be without regard to race, creed, color, sex, marital status or age,
2. UNIVERSITY shall:
A. Commit, upon receipt of, payment for training as described in Section 4.A, a position in PROGRAM for STUDENTS in compliance with the !@Criteria for Selection of Paramedic
Students" in Exhibit B attached hereto and incorporated
herein by this reference.
B. Provide PROGRAM which shall be a structured course of
approximately 1,068 -hours and be composed of the
following learning experiences:
1) Di.dactic: Class work conducted at UNIVERSITY'S EMS
Training Institute by EMSTI staff and guest
lecturers scheduled for approximately 8 hours per
day, Monday through Friday, for approximately nine
(9) weeks. Additional study time of approximately
four hours per day will be required.
2) Clinical: A clinical training experience supervised at the base station hospitals by an assigned Base
Hospital Nurse Coordinator or qualified designee as well as UNIVERSITY Mobile Intensive Care :-.structors for approximately 120 hours. UNIVERSI-:'.: Is Mobile
Intensive Care Instructors will be ax:.ilable by beeper if not- physically on site duzing this scheduled time period. Personal study will also be required during this phase.
3) Field InternshiD: On-the-job training at one of the paramedic provider agencies in San Diego County where STUDENTS are supervised by UNIVERSITY Mobile
Intensive Care Instructors and/or San Diego County
certified EMT-Ps. Schedules are usually twenty-
four hour shifts (an average of fifty-six hours per week) or a twelve hour shift (thirty-six to forty- eight hours per week) to complete a minimum of 551
hours in the field.
C. Provide orientation to STUDENTS, prior to commencement
of training, regarding UNIVERSITY administratiw
policies, standards, and training requirements includinc
@*Due Process for Students in Paramedic Training" as
described in Exhibit C attached hereto and incorporatec herein by this reference.
D. Dismiss STUDENTS from PROGRAM who it finds to be
unsatisfactory for any reason.
3. AGENCY- SHALL: %

Notify STUDENTS of their responsibility to:
A. Comply with UNIVERSITY administrative policies, standards, and practices which include "Rules for Paramedic Interns Regarding School Facilitiestt as
described in Exhibit D attached hereto and incorporated
herein by this reference.
B. Arrange their own transportation and living arrangements.
C. Report to assigned work area on time following all established regulations during the regular scheduled training 'hours.
D. Conform to the standards and practices established by
the AGENCY while training at UNIVERSITY.
E. Purchase smocks, books, folders, and supplies as deemed necessary by the EMS Training Institute.
4. COMPENSATION
A. AGENCY shall pay UNIVERSITY the sum of $4,000.00 for each STUDENT enrolled in PROGRAM which must be paid in full prior to STUDENTts participation in class orientation which is held approximately one week prior to the first
day of course instruction.
B. UNIVERSITY shall refund AGENCY, for STUDENTS who discontinue participation in PROGRAM due to failure to meet performance standards as described in Exhibit A in
accordance with the pre-established schedule in "Refund
Policyft as described in Exhibit E attached hereto and
incorporated herein by this reference.
5. TERM
The term of this Agreement shall be from July 1 , 19s
through August 30 , 1994.
6. TERMINATION
A. Termination Without Cause. Notwithstanding any othe: provision to the contrary, this Agreement may bc terminated without cause at any time by AGENCY 0' UNIVERSITY upon thirty (30) days prior written notice t
the other party.

B. Termination For Material Breach, In the event of a material breach of this Agreement, the aggrieved party may terminate this Agreement by giving written notice of termination of the breaching party, which termination shall be effective immediately upa& delivery or as otherwise specified in such notice; provided, however,
that if the nature of the breach is such that it can
reasonably be cured, said notice shall specify the nature
of such breach, and shall further state that the breaching party shall have thirty (30) days from the effective date of such notice to cure such breach, at
which time, if the breach is not cured, this Agreement shall be terminated.
7. AGENCY'S INSURANCE AND INDEMNIFICATION
AGENCY, at its sole cost and expense, shall insure its activities in connection with this Agreement and obtain, keeg in force and maintain insurance as follows:
A. Medical Professional and Liability Insurance for
bodily injury, property damage and personal injury in an amount no less than one million dollars
($1,000,000) each occurrence, with a general aggregate of five million dollars ($5,000,000) applying, If such insurance is written OH a commercial claims-made form, following termination of this Agreement, coverage shall survive for the maximum reporting period available from insurance sources at each anniversary date of such insurance.
Coverage shall also provide for a retroactive date
of placement coinciding with the effective date of this Agreement.
B. Comprehensive or Commercial Form General Liability
Insurance (contractual liability included) with limits as follows:
(1) Each Occurrence $1,000,00~
(2) Products Completed Operations
Aggregate $5,000,001 (3) Personal and Advertising Injury $1,000,00~ (4) General Aggregate (Not applicable to the Comprehensive form) $5,000,00
However, if such insurance is written on a claims-
made form following termination of this Agreement
coverage shall survive for a period of not less than three years o Coverage -shall provide for a retroactive date of placement coinciding with the effective date of this Agreement.
e. Business Automobile Liability Insurance for owned, scheduled, non-owned, or hired automobiles with a
combined single limit no less than One Million
Dollars ($1,000,000) per occurrence.
D. Worker's Compensation and Employers Liability Insurance in a form and amount covering AGENCY'S full liability under the Workers' Compensation
Insurance and Safety Act of the State of California as .amended from time to t-ime.
E. Such other insurance in such amounts which from time to time may be reasonably required by the mutual consent of UNIVERSITY and AGENCY against other insurable risks relating to performance.
It should be expressly understood, however, that the coverages required under this Section 7,A, B, and C shall not in any way limit the liability of AGENCY.
The coverages referred to under A, B and C of this Section 7. shall be endorsed to-include UNIVERSITY as an insured. Such a provision, however, shall only apply in proportion to and
to the extent of the negligent acts or omissions of AGENCY,
its officers, agents, employees. AGENCY upon the execution
of this Agreement shall furnish UNIVERSITY with Certificates
of Insurance evidencing compliance with all requirements.
Certificates shall further provide for thirty (30) -day advance written notice to UNIVERSITY of any modification, change or
cancellation of any of the above insurance coverages.
AGENCY shall defend, indemnify and hold UNIVERSITY, its
officers, employees and agents harmless from and against any
and all liability, loss, expense (including reasonable
attorneys' fees) , or claims for injury or damages arising out
of the performance of this Agreement but only in proportion
to and to the extent such liability, loss, expense, attorneys' fees, or claims for injury or damages are caused by or result
from the negligent or intentional acts or omissions of AGENCY,
its officers, agents, STUDENTS, or employees.
8. UNIVERSITY'S INSURANCE AND INDEMNIFICATION
UNIVERSITY, at its sole cost and expense, shall insure its activities in connection with this Agreement and obtain, keep
in force and maintain insurance as follows:

9. . COOPERATION IN DISPOSITION OF CLAIMS
AGENCY and UNIVERSITY agree to cooperate with each other in
. the investigation and disposition of third-party liability claiqS:-L arising out of any services provided under this Agreement or in the ,operation of the program. It is the intention of the parties to fully cooperate in the disposition of all such claims. Such cooperation may include joint investigation, defense and disposition of claims of third parties arising from services performed under this Agreement. AGENCY and UNIVERSITY agree to inform one another whenever an incident report is filed or when an investigation is initiated concerning any professional service performed under this Agreement. To the extent allowed by law, AGENCY and UNIVERSITY shall have reasonable access to the medical records and charts of the other relating to any such claim or investigation: provided', however, that nothing in this section
shall require either AGENCY or UNIVERSITY to disclose any peer review documents, records or communications which are privileged under Section 1157 of the California Evidence Code, under the Attorney-Client Privilege or under the Attorney Work-Product Privilege.
10. ARBITRATION
In the event of any dispute between the parties concerning the interpretation or enforcement of the provisions of this Agreement, the parties agree to first attempt in good faith to resolve the dispute mutually between themselves. If unable to do so within thirty (30) days, then all matters in
controversy shall be submitted to arbitration pursuant to California Code of Civil Procedure section 1280, et seq. Arbitration shall be initiated by either party making a written demand for arbitration on the other party. Unless the parties can agree on a single arbitrator within ten (10) days from the receipt of the written demand for arbitration, each party shall designate an arbitrator within ,fifteen (15) days of receipt of the written demand for arbitration. Within seven (7) days of the appointment of two arbitrators, those
arbitrators shall designate a third .arbitrator. The parties
agree that either party to an arbitration may seek judicial review by way of a petition to the court to confirm, correct or vacate an arbitration award pursuant to the provisions of Code of Civil Procedure sections 1285 and 1294.2.
11. INTERRUPTION OF SERVICE
Either party shall ,be excused from any delay or failure in performance hereunder caused by reason 'of any occurrence of contingency beyond its reasonable control, including, but not
limited to, acts of God, acts of war, fire, insurrection,
labor disputes, riots, earthquakes, or other acts of nature.
The obligations and rights of the party so excused shall be
extended on a day-to-day basis for the time period equal to

the period of such excusable interruption. In the event the interruption of the excused party’s obligations continues for a period in excess of thirty (30) days, the other party shall have the right to terminate this Agreement upon ten (10) days prior written notice to the excused party. ” -
12. ATTORNEYS’ FEES
In the event of any action, suit or proceeding, including
arbitration, between the parties hereto, the cost of such action, suit or proceeding, including reasonable attorneys’
fees, shall be borne by the losing party.
13. ASSIGNMENT
Neither AGENCY nc- UNIVERSITY shall assign their rights, duties, or-obligat:.,ns under this Agreement, either in whole or in part, without :he prior written consent of the other.
14. SEVERABILITY
If any provision of this Agreement is held to be illegal,
invalid, or unenforceable under present or future laws effective during the term hereof, such provision shall bc fully severable. This Agreement ’ shall be construed anc enforced as if such illegal, invalid, or unenforceablc provision had never comprised a part hereof, and the remaininc
provisions shall remain in full force and effect unaffectec
by such severance, provided that the invalid provisions arc not material to the overall purpose and operation of thi:
Agreement.
3.5. WAIVER
Waiver by either party of any breach of any provision of thir
Agreement or warranty of representation herein set forth shal
not be construed as a waiver of any subsequent breach of thi same or any other provision. The failure to exercise an:
right hereunder shall not operate as a waiver of such right
~ll rights and remedies provided for herein are cumulative.
16. EXHIBITS
Any and all exhibits attached hereto are incorporated herei
by reference and made a part of this Agreement.
17. MODIFICATIONS AND AMENDMENTS
This Agreement may be amended or modified at any time b
1 mutual written consent of the authorized representatives c both parties. AGENCY and UNIVERSITY agree to amend thj Agreement if such amendment is required by applicabl
regulatory authority and does not materially affect tl relative economic benefits of the parties.
18. ENTIRE AGREEMENT
This Agreement contains all the terms and conditions agreed upon by the parties hereto regarding the subject matter of the Agreement and supersedes any prior agreements, oral or written, and all other communications between the parties
relating to such subject matter.
19. GOVERNING LAW
This Agreement shall be governed in all respects by the laws of the State of California.
20. METHOD OF NOTIFICATION
All notices required under this Agreement shall be deemed to
have been fully given when made in writing and deposited in
the United States mail, postage prepaid, certified mail,
return receipt requested, and addressed as follows:

The paramedic training program is divided into three segments:
I. DIDACTIC
Classwork is conducted at the EMS Training.Institute or a designated facility. It is
scheduled nine hours each day, for forty-seven days.
11. CLINICAL EXPERIENCE
This stage of training is a full time experience held at the base hospitals. During
this time, the schedule will vary and the student may need to work dayslevenings
and/or nights at the assigned hospital.
111. FIELD INTERSSHIP
The final stage returns the student to a paramedic unit where he functions on the
job under supervision of two certified paramedics. The schedule may be a went);-
four hour shift (56 houdweek) or a twelve hour shift (36-45 hours/week) to
conform with normal working hours oE that department. The paramedic intern
needs to complete a minimum of 552 hours in the field.

A. All written work uzll be scored on a straight percentage basis (no curves or othzr
relative ratings).
B. Minimum passing score on all written work is 80% (any retake scores must be a
minimum or' 8.5% to be considered passing).
C. The didactic scorz will be calculated as foUows:
Dailv Quizzes: Each quiz wtll be scored separately and require an 80% .score to
pass. All quizzes must be finished within designated time frames. At the completion
o€ the didactic session, all quiz scores will be averased and will count toward the
overall didactic grade. A student will be dismissed from the program for failing:
1. Five or more quizzes in five consecutive didactic days
3,. Four or more quizzes in one subject area. Subject areas are: Pharmacolog,
EKG, Medical Management, and Skills
3. 30% or more of all quizzes taken
4. Two retake quizzes (passing grade is 85%)
Block I: The block exam will be in four parts, requiring an 80% score in each
part. If a single section of the exam is failed, it ma:, be retaken (requiring an 85%
to be considered passing). However, failure of the retake warrants dismissal €rom
the program. Lf a student has demonstrated prior weakness in training, a failure o€
any part of the bIock exam may warrant dismissal without allowing the student to
repeat the exam. Additionally, failure of two or more sections OE the exam warrants
dismissal from the program.
Block 11: Same as Block I.

11. SIMULATIONS
Separate percentage score grades will be &en for both the preparation OE and overall
participation in at least two'simulations during the ciassroom portion of fr&n, *. The final
simulation grade is based on role performance. Presentations for simulations are graded
as follows:
A. Presentation - 50 points:

8. Role Performance (two participants):
Radio man and patient man will be graded on separate evaluation forms. The intern
will get a chance to partichte in both roles. Any student who receives an overall
wade. Any student who rcxives an overall grade below 80% in role perfonnancc
will receive an overall fail simulation grade which warrants dismissal from the
program.
J orade of below 85% on rc. ;erformance will receive an overall marginal simulation
111. CLNICAL
A. At the assimed clinical area, the student will be evaluated on performance, reliability
technical skills, teamwork, etc. Each of these areas will be judged either Pass
Marginal, or Fail, and an overall clinical evaluation will be done midway and at the
end of clinical. ?lese scores will be the result of the observations, anecdotal notes
and impressions of the staff nurses, physicians, paramedic instructors, clinica
preceptor, and EMSTI instructor.
The student's goal during clinical internship is to achieve at least a "3" or "4' ratinl
in all areas. A rating OE "2" in one area may result in a marginal clinical grade. An
rating oE "1" will result in a failing clinical grade.

B. To successfully completz the ciinical phase of paramedic training, the student must:
1. Complete 120 -hours (includes 8 hours at.-Children's Hospital). hy missed
clinical time must be made up prior to .advancement to the Geld internship.
2. Complete twenty patient evaluation forms; ten to be turned in at the hlidLvay
clinical evaluation, and ten to be turned in at the Final clinicd evaluation.
3. Complete at least two clinical slalls inventory sheets and turn them in to the
EMSTI instructor: - A minimum of one at the Midway clinical evaluation and a minimum oE
one at the Final clinical evaluation. Starred (*) items indicated on the
cLinica1 skills inventory sheet must be compieted without exception.
4. Maintain a proEessiona1 attitude that is not detrimental to patient care.
5. Note the clinical preceptor and EMSTI instructor prior to tardiness or
absenteeism.
C. Situations that will result in a iMARGli\lAL cIinicai grade indude:
1. A medication error (wrong drug, wroq route, wrong patient, wrong dose, etc.).
2. Any starred (*) items not completed on the skrlls inventory sheets.
3. Any patient evaluation sheets not completed in the five parts o€ a mn format,
or less than the required number compIeted and signed off.
D. Situations that will result in a FAIL clinical g-rade include:
1. Gross negiigence (repeated drug mors, abandonment, etc.).
2. Performing a procedure that is outside of the EMT-P scope oE practice in San
Diego County.
3. Attendance at clinical while under the influence of alcohol or drugs.
4. Failure to show consistent improvement in performance of clinical skills as
stated by a learnins contract.
5. Falsifying information on any document (patient chart,.skilIs tally sheet, etc.).
E. A final clinical evaluation will be assigned each student (Pass, Marginal, or Fail).
A failure on the final clinical evaluation warrants dismissal from the program.

IV. FIELD
A. On-the-iob Derformance: Fiei&york will be judged by the daily evaluations and anecdotal notes of the cenified paramedic evaluators, the base hospital personnel,
and the paramedic instructors who have been on mns with the intern. Major
evaluations will be completed midway and at the conclusion of field internship. The
ha1 field evaluation must be a Pass or the student will be dismissed from the
progam. Any missed hours during the field internship must be made up prior to
recommendation for ceecation.
1. On the job performance will be rated on a daily basis utilizing the County of
San Diego Paramedic Internship Performance 'Evaluation Standards.
2. Grades are assigned according to the following criteria:
a. Midway major evaluation:
1-2 rating = fail
2-3 rating = marginal
3-4 rating = pass
b. Final evaluation:
1-2 rating = fail
3-4 rating = pass
B. Field uresentations: At any time during the field internship, the EMSTI instructor,
base hospital nurse coordinator, or paramedic evaluators may request the intern to
present a lecture on any topic they feel is appropriate. Futfillment of this request

skills and the student will be graded Pass or Fail on each skilI. Tne examine

Individuals who fail a s'dl must successfully complete all remaining skills befoc
being allowed to repeat the failed skill. A failure of the skills section consis
of either:
a. Failure of one retake, or

V. OVERALL COURSE PERFORMAiiCE
The four areas ech constitute overall course evaiuations are: Didactic, Clinical, -
Simulations, and -Field.
.' A. Each student will be evaIuated individually for performance during Didactic, Clinicai,
Simulations, and Field. Based upon these evaluations, all decisions concerning the
'dismissal of a student from the program will be made by the Program Director aftcr
consideration of all facts presented.
8. Tardiless or absenteeism is unacceptable and may warrant a marginal grade in thz
speciEic phase of training in which it occurs. Continued tardiness or absenteeism may
warrant dismissal.
C. An overall failure in one area, or overall marginal in two areas, warrants dismissal.
D. An overall marginal didactic evaluation and a marginal midway clinical evaluation
may wanant dismissal.
E. An overaU marginal didactic evaluation and a fail midway clinical evaluation warrants
dismissal.

R. A student may be dismissed from training at any time for an inability to relate to
patients and/or an attitude which is detrimental to patient care.
S. If a student is dismissed from the program or voluntarily withdraws from the course
after the first ten (10) Didactic days, no refunds o€ course lees will be made.
T. If a student fails to meet any oE the performance criteria, he will be dismissed from
the program immediately and will not be permitted to complete the course.

CRITERIA FOR SELECTION OF PARAMEDIC STUDENTS
Candidate must possess a current EMT-I A or EMT-II cerlifiate or have possessed a valid
EMT-I A oc EMT-I1 certificate within the par tweIve, months.
Candidate must have a minimum of six months experience in the provision of emergenq are in
the prehospital setting as an EMT-I A or EMT-11..
Candidate must possess a high schooI diploma or a GED certificate.
Candidate mst submit a transcript from high schooi and from any institute of higher education.
Candidate must possess a current CPR card (AI-WARC).
Candidate must be in good health, have a recent tuberculin skin test (Mantoux PPD) and have a
recent physical examination by a physician (within the last twelve months).
Candidate must pass an entry examination administered by the EMS Training Institute
Candidate must be eighteen years of age or older and enter training voluntarily.

Dm PROCESS FOR STUDENITS IN PARAMEDIC TRAINING
1. At any the during -training if a student feels that he is receiving unfaii tieatment .
or has questions about his status kl the program, he can request a conference 'vith
the primary or back-up instructor tO discuss the issue-
2. Following this conference, if the student feels the issue is untesoIved, he can request
'a conference with the program director. The program director will review all facts
and make a decision regarding the student's status.
3. Lf the student continues to be dissatisfied with the decision made, he can request a
conference with the program medica1 director. The medical director will review all
the facts and make a decision about the student's status. Any decision made by the
medica1 director will be final.
4. Any student who is dismissed koa the program is strongly encouraged to schedule
an exit interview with the program medical director.

Pre-established schedule for refund of training charges:
Mer 1-5 days oE instruction, a $3,250.00 refund will be given.
After 6-10 days OP instruction, a $2,000.00 refund will be given.
After 10 days oE instmction, no refund will be given.
Should the student be dismissed from the paramedic training program for cheating, no
rehnd will be issued, regardless of the number o€ days of htruction.
