RESOLUTION NO. 92-273
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A
MAINTENANCE AND OPERATING AGREEMENT AND A
GRANT OF EASEMENT REGARDING THE PROPOSED CARLSBAD BOULEVARD SHORE PROTECTION PROJECT

WHEREAS, the City Council of the City of Carlsbad has I

determined it necessary, desirable, and in the public interest to
easement with the State of California Department of Parks and g

11 to facilitate the future construction of the Carlsbad Boulevard
12 Shore Protection Project; and

WHEREAS, said agreement and grant of easement has hereby

City of Carlsbad, California, as follows:
1. That the above recitations are true and correct. ~
18 2. That a maintenance and operating agreement and grant
19 of easement between the State of California and the City of
20 Carlsbad regarding the Carlsbad Boulevard Shore Protection Project
21 is hereby approved and the Mayor and City Clerk are authorized and
22 directed to execute said agreement.
23 3. That the City Clerk of the City of Carlsbad is
24 hereby authorized and directed to forward four (4) signed and
25 certified copies of said agreement to: State of California
26 Department of Parks & Recreation, attention Mr. Carleton H.
27 Greenwood, Land Agent, P. 0. Box 942896, Sacramento, California,
28 94296-0001. The City Clerk is further authorized to send one (1)

copy each of said executed agreement to the State of California
Projects Department. 4

Department of Parks and Recreation, attention Mr. Bill Fait, 2680
5 4. The City Clerk is further authorized and directed to

record this agreement and easement in the office of the San Diego
Carlsbad City Council held on the 1st day of SEPTEMBER , 1992, g
PASSED, APPROVED AND ADOPTED at a regular meeting of the 8
County Recorder following its execution by the State of California.
