RESOLUTION NO. 93-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE REIMBURSEMENT FORTHE CONSTRUCTION
OF THE ADAMS STREET STORM DRAIN AND AUTHORIZING PAYMENT TO
MR. AND MRS. YAMANAKA
WHEREAS, on June 19, 1992, Mr. and Mrs. Yamanaka were issued a building
to construct a new home located at 4260 Adams Street; and,
WHEREAS, pursuant to City Code Section 18.40.040, the Yamanakas were requ
a condition of building permit issuance to install new drainage improvements <
reconstruct an existing storm drain beneath Adams Street; and,
WHEREAS, the Yamanakas paid for the construction of said drainage improvc
including the preparation of construction plans for said drainage improvements; and,
WHEREAS, the Yamanakas have submitted a request for reimbursement for
costs incurred in constructing said drainage improvements; and,
WHEREAS, the previous public storm drain improvements were found
substandard and in need of repair and replacement; and,
WHEREAS, adequate money exists to pay for the reimbursement costs fro1
Transnet Local Sales Tax Funds allocated in the 1992-93 budget for miscellaneous
~ drainage improvements.
I NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City Council of the ~
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City agrees to a partial reimbursement in the amount of $1 8,000
construction of the Adams Street storm drain adjacent to 4260 Adams Street.

3. That the Finance Director is authorized to pay Mr. and Mrs. Yamanaka :
from the Transnet Sales Tax Fund account number 342-820-1 843-341 0.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City 1
held on the 16th day of March , 1993 by the following vote, to wit:
