A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA DENYING APPLICANTS' APPEAL AND UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF A NEGATIVE DECLARATION FOR THE HUBBS SEA WORLD RESEARCH INSTITUTE PROJECT ON PROPERTY GENERALLY LOCATED IN THE NORTHWEST
QUADRANT OF THE CITY, EAST OF CARLSBAD

WHEREAS, the findings and conditions of the PI
Commission in Resolutions No. 3522, 3523 and 3524 approvi

WHEREAS, the City Council concludes that there is 1

NOW, THEREFORE, BE IT RESOLVED by the City Council
City of Carlsbad, California, as follows:
1. That the above recitations are true and corre

Use Permit CUP 92-10 and Hillside Development Permit HDP 93
hereby confirmed and the appeal of that decision is denied
forth below based upon the facts set out in the Planning Depz
Staff Report dated July 7, 1993, the evidence before the PI
Commission, the evidence as set forth in City Council Agenc
No. 12,360, and the testimony before the City Council all ol
are incorporated herein by reference.
3. Therefore, the appellants' appeal is denied pr
that the applicant agree to the following conditions:
A. That the project not serve as present or
environmental mitigation for the Encina power plant.
B. The project will stock both the Agua HE
Lagoon and the Batiquitos Lagoon, to the extent scientil feasible, with fish from the project.
C. That the Hubbs-Sea World Research Institu'

The time within which judicial review of this decision must be sought is governed by
Code of Civil Procedure, Section 1094.6, which
has been made applicable in the City of
Carlsbad by Carlsbad Municipal Code Chapter
1.16. Any petition or other paper seeking
judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision become final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such
petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally
delivered or mailed to the party, or. his
attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California 92008.t1
