That the Mayor is authorized to execute said Amendment No. 3 on behalf oft WHEREAS, the City Council of the City of Carlsbad, California, did on July 8 approve a consultant agreement with Boyle Engineering Corporation for design services Poinsettia Lane/l-5 Interchange widening; and WHEREAS, the City Council has reviewed the need to amend said agreement to F for additional construction coordination services. WUTENKRANZ, City Clerk (SEAL) 28 I1 11 0 a Exhibit A to Resolution AMENDMENT NO. 3 TO AGREEMENT FOR DESIGN SERVICES FOR IMPROVEMENTS TO THE POINSETTIA LANE/INTERSTATE ROUTE 5 INTERCHANGE THIS AMENDMENT NO. 3, made and entered into as of the 9th day of SEPTEMBER , 1994, by and between the CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "CITY', and BOYLE ENGINEERING CORPORATION, hereinafter referred to as "CONSULTANT." RAUTENKRANZ, City Clerk ) $- L SF 2 POINSETTIA LANE/I-5 INTERCHANGE e e Exhibit “Ayy - Scope Of Professional Engineering Services Amendment No. 3 To Agreement For Design Services June 10, 1994 This is a scope of professional engineering services for Amendment No. 3 the “Agreement for Design Services for Improvements to the Poinsettia Lanehnterstate Route 5 Interchange,” dated July 8, 199 1. Professional engineering services are needed by the City of Carlsbad (Ci! for construction assistance. This scope of services, prepared by Boyle Engineering Corporation’(Consultant), is based upon our discussions witk the City. Certain assumptions have been made in preparing this scope of services. To the extent possible, they are stated herein. If the actual total effort required is different from the assumptions presented herein, both C and Consultant agree to revise the scope and fee accordingly. In general, this work consists of a) final design tasks not included in the original Agreement for Design Services, and b) providing engineering services related to construction activities. Compensation will be on a timc and materials basis according to the attached rate schedule, not to exceed $70,000. Specifically, Consultant agrees to provide the following servicer 1. Coordinate with Caltrans after delivery of the final plans, specificatic and estimate (PS&E) to assist Caltrans District 11 and Caltrans Headquarters with preparation of the PS&E for advertising, as reque: by the City. This includes responding to Caltrans questions and preparation of a log of borings for the retaining wall. 2. As requested by the City, assist the City in a joint City/Caltrans revie of the bid item prices obtained by Caltrans after opening bids, if bids indicate a cost overrun of no more than 10 percent of the Engineer’s Estimate. 3. As requested by the City, assist the City in consultation with Caltran! determine a course of action should the bids obtained by Caltrans indicate a cost overrun exceeding 10 percent of the Engineer’s Estim 4. Prepare for and attend one preconstruction meeting organized by Caltrans. Document observations with a written memo. 5. Prepare for and attend one partnering workshop organized by Caltra as requested by the City. 6. Prepare for and attend up to I2 regular construction status meetings organized by Caltrans, as requested by the City. 7. After each site visit document observatio with a written memo and photographs. 8. As requested by the City, assist the City in coordinating and consultir with Caltrans’ resident engineer. Document all coordination and consultation activities in writing to the City. 9. A requested by the City, assist the City in reviewing construction contract change orders requested by the contractor. Document all comments in writing to the City. 10. As requested by the City (or Caltrans with City approval), complete revisions to the final calculations, plans, specifications, opinion of probable construction costs as a result of unknown field conditions or unrecorded utilities. 1 1. As requested by the City, review quarterly reports of actual expenditu provided by Caltrans to the City. Document all comments in writing t the City. 12. As requested by the City, review costs of Caltrans services for construction oversight provided by Caltrans to the City. Document comments in writing to the City. 13. As requested by the City, review contract claims which may be filed t the construction contractor. Document comments in writing to the Cit 14. As requested by the City, review the detailed statement of total actual cost of construction, Caltrans services, and contract claims allowed to the construction contractor provided by Caltrans to the City. As requested by the City, review falsework drawings and other bridge shop drawing submittals only for general conformance with the desigl concept of the project and general compliance with the plans and specifications. 16. As requested by the City, review other (non-bridge) shop drawing submittals only for general conformance with the design concept of th project and general compliance with the plans and specifications.
