RESOLUTION NO. 94-292
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING AN AMENDMENT TO THE
CIRCULATION AND SCHOOL FACILITIES SECTIONS OF THE
ZONE 21 LOCAL FACILITIES MANAGEMENT PLAN
CASE NO: LFMP 87-21 (A)
WHEREAS, on July 20, 1994 the Carlsbad Planning Commiz
adopted Resolution No. 3688 recommending to the City Council
Local Facilities Management Plan Amendment 87-21(A) be apprc
and
WHEREAS, the City Council of the City of Carlsbad
October 3, 1994 held a duly noticed public hearing to considel
recommendations and heard all persons interested in or opposc
Local Facilities Management Plan Amendment 87-21(A); and
WHEREAS, on May 2, 1991 a Negative Declaration was appl
for the Zone 21 Local Facilities Management Plan.' No additj
environmental impacts have been identified with this proposed
21 LFMP Amendment. Therefore, the proposed project is in 1
compliance with the previously approved Negative Declaration c
May 2, 1991.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the findings and conditions of the Plar
Commission in Resolution No. 3688 and the amendments set 01:
Exhibit X constitute the findings of the City Council in
matter.
3. That revisions to the Circulation and School Facil:
sections of the Zone 21 Local Facilities Management Plan

approved as follows:
a. That the second paragraph of the Spe
Circulation Facilities condition read as follows:
"Prior to the recordation of the first final
or issuance of a grading or building permit, whichever oc
first, for property located contiguous to either of the
alternative alignments of Poinsettia Lane within Zone 21,
ultimate grade and alignment shall be established for Poinse
Lane between El Camino Real and Alga Road."
b. That a new Special Circulation conditic
added to read as follows:
"Prior to recordation of the first final
within Zone 21, a fee or other financing program guarante
construction of Poinsettia Lane between El Camino Real and
Road shall be approved by the City Council."
c. That the Special School Condition be am€
to read as follows:
"Prior to the approval of any final map or
issuance of any permits within Zone 21 , the applicant for the f
map or permit shall submit evidence to the City that impact
school facilities have been mitigated in conformance with
City's Growth Management Plan to the extent permitted by applic
state law for legislative approvals. If the mitigation invol7
financing scheme such as a Mello-Roos Community Facilities Dist
which is inconsistent with the City's Growth Management
including City Council Policy Statement No. 38 , the developer s
disclose to future owners in the project, to the maximum el

PASSED, APPROVED AND ADOPTED at a Regular Meeting Of
City Council of the City of Carlsbad on the 11th day of OCTOB
1994, by the following vote, to wit:
