RESOLUTION NO. 96-28
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAi
CALIFORNIA, SUMMARILY VACATING PORTIONS OF LA COSTA BOULEVARI
EAST OF CARLSBAD BOULEVARD, PR 6.1 22 AND PR 6.123
WHEREAS, the owners of adjacent property have made a request by the filii
application to vacate for public street purposes portions of the right-of-way for L
Boulevard; and
WHEREAS, the City of Carlsbad did approve Specific Plan 201 which establi:
public improvement and dedication needs for the La Costa Downs subdivision we$
San Diego Northern Railroad right-of-way; and
WHEREAS, said Specific plan 201 recommended the vacation and elimination of I
Boulevard between Anacapa Road and Franciscan Road and between Franciscan Road
San Diego Northern Railroad right-of-way; and
WHEREAS, the right-of-way proposed to be vacated is excess right-of-way, i
needed for any present or prospective future public street purposes; and
WHEREAS, the excess right-of-way has not been used by the public as a public s
over five years; and
WHEREAS, no public funds have been expended to maintain the excess right-of-
over five years; and
WHEREAS, this proposed vacation is in conformance with the General Plan, cum
ordinances, and current Ctty policies; and
WHEREAS, this vacation has had prior environmental review done with the reviev
La Costa Downs Assessment District.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of CE
California, as follows:
1. That the above recitations are true and correct.

2. That pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Hi
Code, those portions of La Costa Boulevard, more particularly described in Exhibits A an
illustrated for the sake of clarity on Exhibit C, and that portion of La Costa Boulevar
particularly described in Exhibit D and illustrated for the sake of clarity on Exhibit E, are
summarily vacated for public street purposes.
3. That an easement and rights necessary to inspect, maintain, repair, I
construct, install, remove or renew in place public utility facilities and public storm drain a
is hereby reserved and excepted from this vacation.
4. That the City Clerk is instructed to record this resolution in the San Diego
Recorder’s Office.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
held on the 23rd day of JANUARY , 1996 by the following vote, to wit:
AYES: Council Members Lewis, Nygaard, Kulchin, Finnila, Hall
NOES: None
ABSENT: None
