RESOLUTION NO. 96 - 86
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
AND ROAD PROGRAM OF PROJECTS (RTIP) FOR FISCAL YEARS 1997
THROUGH 2003.
WHEREAS, on November 3, 1987, the voters of San Diego County approved
CALIFORNIA, ADOPTING THE SEVEN-YEAR TRANSNET LOCAL STREET
Diego Transportation Improvement Program Ordinance and Expenditure Plan; and
WHEREAS, the Ordinance provides that the SANDAG Commission shall apy
multi-year program of projects submitted by local jurisdictions identifying those transpl
projects eligible to use transportation sales tax (TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransN
street and road revenues for Fiscal Years 1997 through 2003; and
WHEREAS, the City of Carlsbad has held a public hearing in accordance with
5(A) of the Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ca
California, as follows:
1. That the above recitations are true and correct.
2. Pursuant to Section 8 of the TransNet Ordinance, the City of Carlsbad certif
the required minimum annual level of local discretionary funds to be expended for strc
road purposes will be met throughout the seven year period consistent with Maintenance t
Requirements adopted by the SANDAG Commission on June 24, 1988.
3. Pursuant to Section 9 of the TransNet Ordinance, the City of Carlsbad certil
TransNet funds programmed in the Seven-Year Program of Projects, attached as Exhib
not replace private developer funding which has been or will be committed for any I
However, the Clty has committed TransNet Local funds for the construction of bc
Poinsettia Lane and La Costa Avenue 1-5 Interchanges, which will be repaid from r(
collected through a combination of Community Facilities District No. 1, Bridge and Thoro1
District, and Federal funds.

4. Pursuant to Section 16 of the TransNet Ordinance, the City of Carlsbad cert
each project of $250,000 or more will be clearly designated during construction with '1
project funding identification signs.
5. The City of Carlsbad does hereby certify that all other applicable provisior
TransNet Ordinance have been met,
6. The City of Carlsbad agrees to hold harmless and defend the SANDAG Corn
against challenges related to local TransNet funded projects.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
held on the 12th day of MARCH , 1996 by the following vote, to wit:
