RESOLUTION NO. 98-224
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS
FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING
TO CANDIDATES STATEMENTS SUBMITTED TO THE
VOTERS AT AN ELECTION TO BE HELD ON TUESDAY,
NOVEMBER 3, 1998.
WHEREAS, Section 13307 of the Elections Code of the State 1
California provides that the governing body of any local agen,
adopt regulations pertaining to materials prepared by a.
candidate for a municipal election, including costs of t
candidates statements;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBA
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER .
FOLLOWS :
SECTION 1. GENERAL PROVISIONS. That pursuant to Secti
13307 of the Elections Code of the State of California, ea
candidate for elective office to be voted for at an election to
held in the City of Carlsbad on November 3, 1998, may prepare
candidate's statement on an appropriate form provided by the Ci
Clerk. The statement may include the name, age and occupation
the candidate and a brief description of no more than two hundr
(200) words of the candidate's education and qualificatio
expressed by the candidate himself or herself. The stateme
shall not include any party affiliation of the candidate, n
membership or activity in partisan political organizations. T
statement shall be filed in the Office of the City Clerk at t
time the candidate's nomination papers are filed. The stateme
may be withdrawn, but not changed, during the period for fili

nomination papers and until 5:OO p.m. of the next working d;
after the close of the nomination period.
SECTION 2. SPANISH LANGUAGE. Pursuant to the Voting Righi
Act, all candidates statements shall also be translated in
Spanish.
SECTION 3. ADDITIONAL MATERIALS. No candidate will
permitted to include additional materials in the sample ball1
package.
SECTION 4. PAYMENT. Each candidate filing a candidate
statement shall be billed for the services rendered a sum n'
greater than his or her actual prorata share of costs fl
printing, handling, mailing the candidate's statements, and f8
the cost of the Spanish translation. Such bill shall be due a:
payable immediately upon receipt thereof.
SECTION 5. Each candidate shall pay a $25.00 fee at t:
time the nomination papers are filed with the City Clerk. In lil
of the $25.00 filing fee, candidates may process a petition-i:
lieu by acquiring four signatures for each $1.00 of the fili:
fee. A total of 100 signatures of registered voters in the Ci.
shall replace the $25.00 filing fee. Petitions-in-lieu must :
submitted to the City Clerk's Office no later than 5:OO p.m., I
July 23, 1998.
SECTION 6. That the City Clerk shall provide ea1
candidate, or the candidate's representative, a copy of th
resolution at the time nominating petitions are issued.
SECTION 7. That this resolution shall apply only to the

election to be held on November 3, 1998, and shall then 1
repealed.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of tl
City Council of the City of Carlsbad on the 7th day of
July , 1998, by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin and Hall
NOES : None
ABSENT : Council Member Nygaard
