A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING THE SIX-YEAR
1998-04 REGIONAL TRANSPORTATION IMPROVEMENT
PROGRAMRRANSNET PROGRAM OF PROJECTS FOR
CARLSBAD.
WHEREAS, on November 3, 1987, the voters of San Diego County approved th
San Diego Transportation Improvement Program Ordinance and Expenditure Plan; and
WHEREAS, the Ordinance provides that the SANDAG Commission shall approve
multi-year program of projects submitted by local jurisdictions identifying those transportatio
projects eligible to use transportation sales tax (TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet loci
street and road revenues for Fiscal Years 1998 through 2004; and
WHEREAS, the City of Carlsbad has held a public hearing in accordance wit1
Section 5(A) of the Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbac
California, as follows:
I. That the above recitations are true and correct.
2. That the 1998-04 Regional Transportation Improvement ProgramlTransNc
Program of Projects for Carlsbad, attached as Exhibit 1, is hereby approved.
3. Pursuant to Section 8 of the TransNet Ordinance, the City of Carlsbad certifie
that the required minimum annual level of local discretionary funds to be expended for street an
road purposes will be met throughout the six-year period consistent with Maintenance of Effo.
Requirements adopted by the SANDAG Commission on June 24, 1988.
4. Pursuant to Section 9 of the TransNet Ordinance, the City of Carlsbad certifie
that TransNet funds programmed in the Six-Year 1998-04 Regional Transportation lmprovemer
ProgramlTransNet Program of Projects for Carlsbad do not replace private developer fundinl
which has been, or will be, committed for any project.
5. Pursuant to Section 16 of the TransNet Ordinance, the City of Carlsbad certifie
that each project of $300,000 or more will be clearly designated during construction wit
TransNet project funding identification signs.

2 6. The City of Carlsbad does hereby certify that all other applicable provisions of th
3 TransNet Ordinance have been met.
4 7. The City of Carlsbad agrees to hold harmless and defend the SANDA(
Commission against challenges related to local TransNet funded projects. 5
6 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Counc
7 held on the 21st day of July , 1998 by the following vote, to wit:
8 AYES: Council Members Lewis, Finnila, Nygaard, Kulchin and Hall
