RESOLUTION NO. 99-17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE MEMORANDUM OF
UNDERSTANDING FOR THE SRO PROGRAM BETWEEN THE
CITY OF CARLSBAD AND SAN DlEGUlTO UNION HIGH
SCHOOL DISTRICT
WHEREAS, the City Council of the City of Carlsbad, California, does hereby re:
follows:
1. That the Memorandum of Understanding for the SRO Program, attached he

MEMORANDUM OF UNDERSTANDING
BETWEEN
SAN DIEGUITO UNION HIGH SCHOOL DISTRICT
AND
CITY OF CARLSBAD
MISSION STATEMENT It is the mission of the Carlsbad Police Department i~
concert with the San Dieguito Union High School District to provide a safe
secure, peaceful teaching and learning environment for all students and std
within the City of Carlsbad by protecting life and property.
Ensuring the safety of students and staff on school campuses in Carlsbad is
priority to the school administration and the police department. Campu
security will be increased by the presence of police officers who will interac
with the students in .both a positive and proactive manner. Police officers 0:
campus will help improve relations between the police department and th
youth of the community. Therefore, the San Dieguito Union High Schoc:
District and the City of Carlsbad have the, following expectations and agree t
undertake the listed responsibilities to achieve these mutual objectives:
A. SCHOOL DISTRICT’S ROLE AND RESPONSIBILITY
1. To ensure student welfare portal to portal;
2. To develop procedures to handle campus safety issues;
3. To establish and follow procedures for referring police involvemen
and
4. To cooperate with and support in a proactive manner the City (
Carlsbad Police Department to ensure the success of program
involving students, school personnel, parents and the community.
B. SCHOOL RESOURCE OFFICER’S ROLE AND RESPONSIBILITY
1. To provide prevention/intervention by:
To provide high visibility of uniform police officer presence on tl-
campus of the La Costa Canyon High School located in the City t
Carlsbad.
Developing classroom and faculty presentations relating to the
youth and the law;
Attending parent conferences/meetings;

0 Attending S.A.R.B. (Student Attendance Review Board) and
meetings;
0 Scheduling security activities as needed;
Be the first response in all law enforcement related matters as the:
occur during regular school hours;
To attend various sporting events and school activities as needed
for proactive enforcement and interaction; and
To document all incidents of crime as per department regulations.
2. To continue to work with:
Community agencies; and
Parent/teacher groups as needed throughout the school.
3. To assist investigative personnel of the Carlsbad Police Departmen
San Diego County Sheriff's Department and other law enforceme]
agencies who are assigned to any ongoing investigation and/(
preliminary investigation of criminal activity within the school.
4. To work with school staff and district personnel in the matter 1
mutual concern such as:
Alcohol and drug use on campus;
Safety of students and staff on campus;
Gang-related violence and crime;
Campus intrusion; and
Loss and/or damage to property.
C. TIME FRAME
This Memorandum of Understanding shall remain in effect for the 199
1999 public school fiscal year, and may be extended for such length
time as both parties mutually agree to continue this Memorandum
Understanding. However, either party shall have the right to cancel tk

Memorandum of Understanding upon 90 days advance written noticc
during the term of this agreement.
D. SPAN OF CONTROL/JURISDICTION
One full-time police officer will be assigned to provide the School Resourc'
Program to La Costa Canyon High School.
Prevention/education/training/proactive activities will take place at L
Costa Canyon High School and at public meeting places within th
community as it relates to the San Dieguito Union High School Distric
activities.
The officer will remain under the direction and control of the Carlsba
Police Department. Requests for work assignments will be issued from th
superintendent/principal's office to the training sergeant of the Carlsba
Police Department? who will thereafter direct the school resource officer t
respond appropriately to the request.
E. RESOURCE
Resource and local management will be coordinated at:

F. COST
Cost sharing will be based upon the services of one full-time police officl
for nine months of the school year. The portion funded by the District w
be prorated based upon the school year (nine months) at a rate of one hr
of total compensation of one full-time sworn police officer. Tot
compensation includes salary, estimated overtime and benefits. St
Exhibit A for details.
This Memorandum of Understanding will be effective July 1, 1998, and tl
San Dieguito Union High School District will pay annually, upon executic
of this Memorandum, to the Finance Director of the City of Carlsbad tl
agreed amount as outlined in Exhibit A. If the agreement is .canceled i
herein permitted, City shall forthwith return to the District the portion

such payrnent allocable to the period of the term subsequent to tht
effective date of cancellation.
G. NO INDEPENDENT BASIS FOR LIABILITY
Nothing herein shall create, by this or other understanding between thc
parties, an independent basis for liability of the City to either the Distric
or to a third party for failing to respond or for responding to a call fo
police services in a dilatory or negligent manner. The City’s liability, j
any, shall be determined by law without regard to the existence of thi
