RESOLUTION NO. 99-202
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION, SPECIFIC PLAN AMENDMENT, LOCAL
COASTAL PROGRAM AMENDMENT, SITE DEVELOPMENT
PLAN AMENDMENT, AND COASTAL DEVELOPMENT PERMIT
TO PERMIT THE EXISTING 6,500 SQUARE FOOT NAMM
MUSEUM OF MAKING MUSIC TO BE OPEN TO THE PUBLIC,
WITH INCIDENTAL RETAIL SALES RELATED TO THE
MUSEUM ON PROPERTY LOCATED AT 5790 ARMADA DRIVE
IN THE COASTAL ZONE AND LOCAL FACILITIES
MANAGEMENT ZONE 13

The City Council of the City of Carlsbad, California, does hereby resoh
follows:
WHEREAS, on April 21, 1999 and May 5, 1999, the Carlsbad Plar
Commission held duly noticed public hearings to consider a proposed Negative Declarz
Specific Plan Amendment, Local Coastal Program Amendment, Site Development
Amendment, and Coastal Development Permit to permit an existing 6,500 square foot mu:
to be open to the general public with incidental retail sales related to the museum, and adc
Resolutions No. 4537, 4538, 4539, 4540, and 4541 recommending to the City Council ths
Negative Declaration, Specific Plan Amendment, Local Coastal Program Amendment,
Development Plan Amendment, and Coastal Development Permit be approved; and
WHEREAS, the City Council of the City of Carlsbad, on 1st d2
June , 1999, held a duly noticed public hearing to consider the recommendation
heard all persons interested in or opposed to the Negative Declaration, Specific
Amendment, Local Coastal Program Amendment, Site Development Plan Amendment,
Coastal Development Permit; and
NOW THEREFORE, BE IT RESOLVED by the City Council of the Cit
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the approv
the Negative Declaration, Specific Plan Amendment SP 207(D), Local Coastal Proc

Commission contained in Planning Commission Resolutions No. 4537, 4538, 4539, 454C
4541 on file with the City Clerk and incorporated herein by reference, are the finding:

The Provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Ju
Review” shall apply:
“NOTICE TO APPLICANT”
“The time within which judicial review of this decision must be sought is
governed by Code of Civil Procedure, Section 1094.6, which has been
made applicable in the City of Carlsbad by Carlsbad Municipal Code
Chapter 1 .I 6. Any petition or other paper seeking judicial review must
be filed in the appropriate court no later than the ninetieth day following
the date on which this decision becomes final; however, if within ten
days after the decision becomes final a request for the record of
proceedings accompanied by the required deposit in an amount
sufficient to cover the estimated cost of preparation of such record, the
time within which such petition may be filed in court is extended to not
latter than the thirtieth day following the date on which the record is
either personally delivered or mailed to the party, or his attorney of
record, if he has one. A written request for the preparation of the
record of the proceedings shall be filed with the City Clerk, City of
Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California 92008.”
PASSED AND ADOPTED at a regular meeting of the City Council of the C’
