RESOLUTION NO. 99-338
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING THE HABITAT
MANAGEMENT PLAN FOR NATURAL COMMUNITIES IN THE
CITY OF CARLSBAD AND AUTHORIZING STAFF TO SUBMIT
THE HABITAT MANAGEMENT PLAN TO THE CALIFORNIA
DEPARTMENT OF FISH AND GAME AND U.S. WILDLIFE
SERVICE (“WILDLIFE AGENCIES”) FOR REVIEW AND
APPROVAL.

WHEREAS, the City of Carlsbad has prepared a Habitat Management Pla
Natural Communities in the City of Carlsbad pursuant to Section lO(a) of the Fel
Endangered Species Act, Section 2081 of the State Endangered Species Act and in accord
with the NCCP Program of the State of California; and,
WHEREAS, the City has prepared the Plan in consultation with the WI
Agencies and in cooperation with property owners, members of the development comm
and environmental organizations and all other interested parties; and
WHEREAS, the Plan has been prepared in coordination with the Regi
Multiple Habitat Conservation Plan/MHCP and is considered a Subarea Plan of .the MHCP; 2
WHEREAS, on June 8, 1999, the City Council received a staff presentatio
the Plan and opened a 45-day public review and comment period; and
WHEREAS, 35 letters containing written comments have been submitted
responded to by staff; and
WHEREAS, all comments received during the public review period and
responses have been reviewed by the City Council; and
WHEREAS, a Mitigated Negative Declaration has been approved for the Pla
the City Council and it has been determined that any potentially significant environmr
impacts that would result from approval and implementation of the Plan have been mitigated
less than significant level; and

WHEREAS, on September 21, 1999, the City Council held a duly noticed p
hearing to consider the Habitat Management Plan, reviewed the written comments on the
and heard all persons who wished to provide public testimony regarding the Plan; and
WHEREAS, the City Council has determined that the Plan has been preparc
conformance with the Federal and State Endangered Species Acts, the State NCCP Prog
that it is consistent with the ongoing Regional MHCP and that it adequately protects na
habitats in these communities; and
NOW, THEREFORE BE IT RESOLVED by the City Council of the Cii
Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That the City Council approves the Habitat Management Plan accordin
the HMP document provided to the City Council on June 8, 1999, and the revisions provide
the Council on September 21, 1999, and attached as Exhibit 7.
