A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A MITIGATED
NEGATIVE DECLARATION, ADDENDUM AND MITIGATION
MONITORING AND REPORTING PROGRAM, SITE
DEVELOPMENT PLAN AMENDMENT NO. SDP 96-14(A) AND
COASTAL DEVELOPMENT PERMIT AMENDMENT 96-16(A) TO
INCREASE THE BUILDING HEIGHT, PERMIT DEVELOPMENT
OF EXPANSION AREAS 1 AND 3, AND PERMIT THE
CONSTRUCTION OF THE BATFLYER RIDE IN THE CASTLE
HILL CLUSTER OF LEGOLAND ON PROPERTY GENERALLY
LOCATED ON THE NORTH SIDE OF PALOMAR AIRPORT
ROAD EAST OF ARMADA DRIVE AND WEST OF HIDDEN
VALLEY ROAD WITHIN PLANNING AREA 4 OF THE
CARLSBAD RANCH SPECIFIC PLAN IN LOCAL FACILITIES
MANAGEMENT ZONE 13.

The City Council of the City of Carlsbad, California, does hereby resoh
follows:
WHEREAS, on April 19, 2000 the Carlsbad Planning Commission held a
noticed public hearing to consider a proposed Mitigated Negative Declaration, Adden
Mitigation Monitoring and Reporting Program, Site Development Plan Amendment and Cc
Development Permit Amendment to increase the building height, permit developme
Expansion Areas 1 and 3, and permit the construction of the Batflyer Ride and ad(
Resolutions 4754, 4755 and 4756 recommending to the City Council thlat the Miti!
Negative Declaration, Addendum, Mitigation Monitoring and Reporting Program,
Development Plan Amendment and Coastal Development Permit Amendment be appr
and
WHEREAS, the City Council of the City of Carlsbad, on the - 16th
day of May , 2000 held a duly noticed public hearing to conside
recommendation and heard all persons interested in or opposed to the Mlitigated Ne!
Declaration, Addendum, Mitigation Monitoring and Reporting Program , SDP 96-14(A) and
96-1 6(A); and
WHEREAS, an Initial Study was prepared for the project and it was deter1
that the project had complied with the mitigation measures of Program Environmental 11

applications, on January 9, 1996 by the City Council and that only one additional mitic
measure was needed and was latter made inapplicable by the City Council’s repeal oi
moratorium related to the traffic impacts for the intersection of El Camino Flea1 and Pa
Airport Road,
NOW THEREFORE, BE IT RESOLVED by the City Council of the C
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the appro’
Mitigated Negative Declaration, Addendum, Mitigation Monitoring Program, Site Develop
Plan Amendment 96-14(A) and Coastal Development Permit Amendment 96-’1 6(A) is appl
and that the findings and conditions of the Planning Commission contained in Plal
Commission Resolutions No. 4754, 4755 and 4756 on file with the City Clerk and incorpo
herein by reference, are the findings and conditions of the City Council.
3. This action is final the date this resolution is adopted by the City Co
The Provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Ju
Review” shall apply:
“NOTICE TO APPLICANT”
“The time within which judicial review of this decision must be sought is
governed by Code of Civil Procedure, Section 1094.6, which has been
made applicable in the City of Carlsbad by Carlsbad Municipal Code
Chapter 1.16. Any petition or other paper seeking judicial review must be
filed in the appropriate court no later than the ninetieth day following the
date on which this decision becomes final; however, if within ten days
after the decision becomes final a request for the record of proceedings
accompanied by the required deposit in an amount sufficient to cover the
estimated cost of preparation of such record, the time within which such
petition may be filed in court is extended to not latter than the thirtieth day
following the date on which the record is either personally delivered or
mailed to the party, or his attorney of record, if he has one. A written
request for the preparation of the record of the proceedings shall be filed
with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive,
Carlsbad, California 92008.”
