2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
3 CALIFORNIA, APPROVING AN APPROPRIATION OF ADDITIONAL
FUNDS FOR THE CARLSBAD BOULEVARD REALIGNMENT
4 PROJECT, PD 99-lS/DWG 383-3 - PROJECT NO. 36171.
5 WHEREAS, Shea Homes (Shea) and Fieldstone Communities (Fieldstone), in accordance
6 with conditions of approval for their respective projects, have partnered with the City of Carlsbad
7 to realign and improve Carlsbad Boulevard (Improvements) along their respective project
s frontages; and,
WHEREAS, Shea previously agreed to take the lead on completing the Improvements for

the Shea and Fieldstone frontages; and,
10 WHEREAS, Shea and the City previously entered into a reimbursement agreement to
11 complete certain improvements for the public benefit; and,
12 WHEREAS, the previously approved reimbursement agreement included a preliminary
13 cost estimate; and,
14 WHEREAS, due to additional enhanced landscaping treatment for the Carlsbad Boulevard
15 raised median, and construction bid cost estimates that show an increase to overall project line
16 item costs; and, due to construction change orders, overall project cost estimates have increased;
17 and,
WHEREAS, to cover the City’s reimbursement obligations, including the State Park’s 16
portion of the Carlsbad Boulevard/Poinsettia Lane/State Park’s entrance improvements, an 19
additional appropriation of $360,000, from the General Fund is required.
20 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cartsbad,
21 California, as follows:
22 1. That the above recitations are true and correct;
23 2. That City Council finds that it is in the best interest of the City of Carlsbad to
24 maintain aesthetically pleasing, scenic roadways for citizens and guests of Carlsbad;
25 3. That to maintain this scenic roadway (Carlsbad Boulevard) it is necessary to install
26 an enhanced landscaped raised median;
27 4. That to install this enhanced landscaped raised median, additional funding must be
appropriated to cover the construction costs for the median; 26

5. That the Finance Director is hereby authorized to transfer $360,000 from the
Gas Tax Fund to the project account to cover said costs.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 17th day of April t 2001 by the following vote, to wit:
AYES: Council Members Kulchin, Finnila, Nygaard and Hall.
NOES: None.
ABSENT: Council Member Lewis
