RESOLUTION NO. 2002-253
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, GRANTING RELIEF TO THE LOWEST
BIDDER AND REJECTING ALL BIDS FOR THE CONSTRUCTION
OF THE PUBLIC WORKS CENTER AND FIRE STATION NO. 5
STORAGE FACILITY AND SKATE PARK RESTROOMS, PROJECT NOS. 3572.3688. AND 3655.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
lecessary at this time to reject all bids for the construction contract for the Public Works Center,
'roject Nos, 3572 and 3688, and Fire Station No. 5 Storage Facility and Skate Park Restrooms,
'roject No. 3655; and
WHEREAS, all bids came in over the engineer's estimate of $13,100,000; and
WHEREAS, the lowest responsible and responsive bidder, Nielsen Dillingham Builders,
nade a mistake in its bid making the bid materially different than it intended its bid to be.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
:alifornia, as follows:
1. That the above recitations are true and correct
2. That all bids received for the Public Works Center, Project Nos. 3572 and 3688, and
:ire Station No. 5 Storage Facility and Skate Park Restrooms, Project No. 3655 be rejected.
3. That Nielsen Dillingham Builders is hereby relieved from its bid.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
leld on the 13th day of AUGUST , 2002 by the following vote, to wit:
