RESOLUTION NO. 2003-263
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR THE
CONSTRUCTION OF SUNNYHILL DRIVE DRAINAGE
IMPROVEMENTS, PROJECT NO 3839.
WHEREAS, on May 6, 2003 the City Council of the City of Carlsbad, California, authorized
the advertisement for bids for the construction of Sunnyhill Drive Drainage Improvements,
Project No. 3839 in Agenda Bill #17,156 and Resolution No. 2003-1 16; and
WHEREAS, the Engineer’s Estimate for construction of Project No. 3839 was fifty
thousand dollars ($50,000); and
WHEREAS, six sealed bids were received on July 9, 2003 by the City of Carlsbad for the
construction of Sunnyhill Drive Drainage Improvements, Project No. 3839; and
WHEREAS, all bid documents received from all bidders have been reviewed in detail and
the City Council does hereby find that the lowest responsible and responsive bidder, Don Hubbard
Contracting Company, did submit a bid in the amount of $43,301; and
WHEREAS, there are sufficient appropriations to construct the Sunnyhill Drive Drainage
Improvements, Project No. 3839; and
WHEREAS, Subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the City
Manager to approve change orders in the amount equal to the contingency set at the time of the

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
Zalifornia, as follows:

That the above recitations are true and correct.
That the bid of $43,301 submitted by Don Hubbard Contracting Company for
:onstruction of Sunnyhill Drive Drainage Improvements, Project No. 3839, is accepted and the
Mayor is hereby authorized and directed to execute a contract therefor.
3. That the City Manager is authorized to approve change orders in the amount of
61 3,000 for Project No. 3839.
4. That the award of this contract for Project No. 3839 is contingent upon Don Hubbard
Zontracting Company executing the required contract and submitting the required bonds and

insurance policies as described in the contract within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extension of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 7th day of October , 2003 by the following vote, to wit:
