RESOLUTION NO. 2004-373
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AGREEING TO REIMBURSE CMWD THE ACTUALCOSTSFORTHECONSTRUCTIONOFTHEPASEODEL
NORTE RECYCLED WATER PIPELINE REPLACEMENT, PROJECT
NOS. 3914 AND 3679.
WHEREAS, on June 1, 2004, the plans and specifications for construction of the Paseo
Del Norte Recycled Pipeline Replacement, Project Nos. 3914 were approved by the Board of
Directors of the Carlsbad Municipal Water District; and
WHEREAS, on April 22, 2003, the plans and specifications for pavement overlay work
along Paseo Del Norte, Project 3679, were approved by the City Council of the City of Carlsbad,
and
WHEREAS, the pavement overlay work was postponed to coordinate with the
replacement of the recycled pipeline; and
WHEREAS, seven (7) sealed bids were received on September 23, 2004 at 4:OO p.m. for
the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Special Service Contractors, Inc., in the amount of $563,748; and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, the Carlsbad Municipal Water District will be entering into a contract with
Special Service Contractors, Inc. to complete Projects 3914 and 3679; and
WHEREAS, the estimated costs of the pavement overlay work is $219,708.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.

2. That the Finance Director be authorized to release funds to CMWD at such time as
reimbursement becomes certain for the pavement overlay work of Paseo Del Norte during the
construction of the Paseo Del Norte Water Pipeline Replacement.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 16th day of November , 2004 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin, Hall and Packard.
