RESOLUTION NO. 2005-019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AGREEING TO REIMBURSE CARLSBAD
MUNICIPAL WATER DISTRICT THE ACTUAL COSTS FOR
PAVEMENT OVERLAY AND THE PLACEMENT OF FIBER OPTIC
CABLING CONDUIT DURING THE CONSTRUCTION OF THE
INDUSTRIAL PARK PIPELINES, FOR THE ENCINA BASIN WATER
RECLAMATION PROGRAM, PHASE I1 PROJECT, PROJECT NOS.
3887-C, 3667. AND 3930 AND APPROPRIATION OF FUNDS.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
iecessary, desirable, and in the public interest to support the construction of the Industrial Park
'ipelines for the Encina Basin Water Reclamation Program, Phase II Project, Project Nos.
3887-C, 3667, and 3930; and
WHEREAS, the Carlsbad Municipal Water District will be entering into a contract with
1. Fletcher Creamer to complete Project Nos. 3887-C, 3667, and 3930; and
WHEREAS, the Project includes a pavement overlay component on the following streets:
=araday Avenue, Rutherford Road, Aston Avenue, Farnsworth Court, Balfour Court, Pascal Court,
'riestly Drive, La Place Court, Geiger Court, Landau Court, Pasteur Court, Darwin Court, and
:amino Vida Roble, Project 3667; and
WHEREAS, the Project also includes a fiber optic cable conduit component along
-araday Avenue between the City's Faraday Building, Farmer's Building and the Safety Center,
3-oject 3930; and
WHEREAS, the pavement overlay component of the project is estimated to cost
92,061,255 and sufficient TransNet Local funds are appropriated; and
WHEREAS, the fiber optic cable conduit component of the project is estimated to cost
b236,360 and an appropriation increase in the amount of $142,760 from the General Capital
Zonstruction Fund is required to complete this portion of the overall project; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
:alifornia, as follows:

That the above recitations are true and correct.
That the Finance Director be authorized to release funds to CMWD at such time as
,eimbursement becomes certain for the pavement overlay work and the placement of the fiber
iptic cable conduit during the Construction of the Industrial Park Pipelines.
3. That the Finance Director is authorized to appropriate an additional $142,760 from
:he General Capital Construction Fund for the fiber optic cable conduit portion of the project.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
7eld on the 18th day of JANUARY , 2005 by the following vote, to wit:
AYES: Council Members Hall, Kulchin, Packard, Sigafoose
NOES: None
ABSENT: Council Member Lewis
