RESOLUTION NO. 2905-047
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND
AWARDING A CONTRACT FOR THE CONSTRUCTION OF
PINE AVENUE PARK, CONTRACT NO. 38022.
WHEREAS, on October 12, 2004, the Carlsbad City Council approved the plans and
specifications and authorized the advertisement of bidding for the construction of Pine Avenue Park,
hereafter the “Project;” and
WHEREAS, 12 sealed bids were received by the City and opened in public on January 19,2005;
and;
WHEREAS, the apparent low bidder, Environmental Construction, made a clerical error in
preparing their bid, and has been requested to be relieved of their bid, and;
WHEREAS, the lowest responsive, responsible bid has been determined to be that which was
submitted by EDGE Development, Inc. in the amount of $4,800,007; and
WHEREAS, sufficient Public Facility Fee funds are available in the project account to fund
construction of the project; and
WHEREAS, the City Council of the City of Carlsbad, California, hereby finds it necessary,
desirable, and in the public interest to proceed with the award of a construction contract for this Project at
this time.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the bid submitted by Environmental Construction is relieved from further consideration.
That bids received by the City and opened on January 19, 2005 are hereby accepted and the
lowest responsive, responsible bid received is hereby determined to be that which was submitted
by EDGE Development, Inc., in the amount of $4,800,007.
That said bid received by City from EDGE Development, Inc. is accepted, the construction
contract is hereby awarded to this firm, and the Mayor is authorized to execute said contract on
behalf of the City.

5. That the City Manager is hereby given the authority to approve construction change orders, singly
or in aggregate, for the Project, up to the amount of the specified contingency.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held
onthe 15th dayof February ,2005 by the following vote, to wit:
