RESOLUTION NO. 2005-300
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA,
APPROVING A BOUNDARY MAP SHOWING
THE BOUNDARIES OF THE TERRITORY
PROPOSED TO BE INCLUDED IN PROPOSED
COMMUNITY FACILITIES DISTRICT NO. 3 AND
THE IMPROVEMENT AREAS THEREIN
WHEREAS, the City Council of the City of Carlsbad, California (“City Council”), desires to
initiate proceedings to establish a Community Facilities District pursuant to the terms and
provisions of the “Mello-Roos Community Facilities Act of 1982,” being Chapter 2.5, Part 1,
Division 2, Title 5 of the Government Code of the State of California (the ”Act”). This Community
Facilities District shall hereinafter be designated as Community Facilities District No. 3 (the
“District”); and,
WHEREAS, there has been filed in the office of the City Clerk of the City of Carlsbad (the
“City Clerk”) and submitted to this City Council a map showing the boundaries of the territory
proposed for inclusion in the District and two improvement areas therein including properties and
parcels of land proposed to be subject to the levy of a special tax by the District.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD HEREBY
RESOLVES AS FOLLOWS:
1. The above recitals are true and correct.
2. The map on file in the office of the City Clerk designated as “BOUNDARY MAP
COMMUNITY FACILITIES DISTRICT NO. 3, CITY OF CARLSBAD, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA showing the boundaries of the territory proposed for
inclusion in the District and the improvement areas therein, including the parcels of land
proposed to be subject to the levy of a special tax bv the District, is hereby approved.

map of the District, evidencing the adoption of this Resolution and, within fifteen (15) days
after the adoption of the Resolution fixing the time and place of the hearing on the
establishment or extent of such District, a copy of such map shall be filed with the correct

and proper endorsements thereon with the County Recorder of the County of San Diego,
all in the manner and form provided for in Sections 31 10 and 31 11 of the Streets and
Highways Code of the State of California.
4. This resolution shall take effect upon its adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 4th day of October , 2005 by the following vote, to wit:
