CARLSBAD, CALIFORNIA, APPROVING THE 2006
FIVE-YEAR REGIONAL TRANSPORTATION IMPROVEMENT
PROGRAM (RTIP) FOR CARLSBAD.
WHEREAS, on November 3, 1987, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (87-01); and
WHEREAS, on November 4, 2004, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (04-01)
extension; and
WHEREAS, that both Ordinances provide that SANDAG, acting as the Regional
Transportation Commission, shall approve a multi-year program of projects submitted by local
jurisdictions identifying those transportation projects eligible to use transportation sales tax
(TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
street and road revenues for Fiscal Years 2006/07 through 2010/11; and
WHEREAS, the City of Carlsbad has held a public hearing in accordance with Section
5(A) of both Ordinances; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the 2006 Five Year Regional Transportation Improvement Program (RTIP) for
Carlsbad attached to the agenda bill as Exhibit 1, is hereby approved.
3. That pursuant to Section 8 of both TransNet Ordinances, the City of Carlsbad certifies
that the required minimum annual level of discretionary funds be expended for street and local
purposes will be met through the five-year period consistent with Maintenance of Effort
Requirements adopted by the SANDAG Commission on June 24, 1988 and on May 28, 2004.

4. That pursuant to Section 9 of the TransNet Ordinance, the City of Carlsbad certifies
that the TransNet funds programmed in the 2006-10 RTIP for the City of Carlsbad do not replace
private developer funding which has been or will be committed for any project.
5. That pursuant to Section 9a of the TransNet extension Ordinance, the City of
Carlsbad certifies that the agency will extract $2,000 from the private sector for each newly
constructed residential housing unit in that jurisdiction to the Regional Transportation Congestion
Improvement Program (RTCIP) beginning no later than July 1, 2008.
6. That pursuant to Section 16 of the TransNet Ordinance, the City of Carlsbad certifies
that each project of $250,000 or more will be clearly designated during construction with TransNet
project funding identification signs.
7. That the City of Carlsbad does hereby certify that all other applicable provisions of the
TransNet Ordinances 87-01 and 04-01 have been met.
8. That the City of Carlsbad agrees to hold harmless and defend the SANDAG
Commission against challenges related to local TransNet funded projects.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 6th day of June , 2006 by the following vote, to wit:
