WHEREAS, MH Carlsbad, LLC has submitted a request to temporarily close West Oaks

Way at Palomar Oaks Way due to illegal dumping, loitering, and other undesirable behavior; and
6
WHEREAS, no objections were received by public utility agencies notified regarding this
temporary closure; and
WHEREAS, Section 21101 (a)(1) of the California Vehicle Code allows local authorities
to adopt regulations to close a street under their jurisdiction when, in the opinion of the legislative
body, the street is no longer needed for vehicular traffic; and
CARLSBAD, CALIFORNIA, TO TEMPORARILY CLOSE WEST
WHEREAS, the City Council has determined that West Oaks Way is unnecessary for
public vehicular traffic until development along West Oaks Way occurs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
d c 1. That the above recitations are true and correct.TO
2. There is no current need to keep open West Oaks Way at Palomar Oaks Way for16
vehicular traffic.

3. City staff shall install a temporary gate and k-rail across West Oaks Way at
18 Palomar Oaks Way with emergency access provided by key locks, including appropriate
19 regulatory and warning signs.
4. City staff will maintain the temporary gate until its eventual removal.
5. City staff shall remove said temporary gate, k-rail and signage once development
on West Oak Way occurs.

of the City of Carlsbad on the 25th day of July, 2006, by the following vote:
