RESOLUTION NO. 2006-219

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, CONDITIONALLY ACCEPTING THE
CONSTRUCTION OF MELROSE DRIVE FROM PALOMAR
4 AIRPORT ROAD TO THE CITY'S NORTHERLY BOUNDARY,
CT 99-06 .

WHEREAS, Melrose Drive meets the criteria of a circulation element roadway as defined
6
in the City's General Plan and Council Policy No. 63; and
WHEREAS, the construction of Melrose Drive from Palomar Airport Road to the City's
8
northerly boundary as shown on drawing number 399-4 has been substantially completed to the
9
City's satisfaction; and
WHEREAS, the completion of the ultimate improvements cannot take place at this time
due to the need for additional right-of-way;
WHEREAS, an interim striping plan, drawing number 399-4c, that allows for the opening

of Melrose Drive prior to completion of the ultimate improvements, has been filed with the City14
Engineer;\ o
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,16
California, as follows:
18 1. That the above recitations are true and correct.
19 2. That the construction of Melrose Drive from Palomar Airport Road to the City
20 northerly boundary, as shown on Drawing Number 399-4, is substantially complete.
21 3. An interim striping plan, drawing number 399-4c is on file with the City Engineer.
22 4. The City conditionally accepts Melrose Drive between Palomar Airport Road and
23 the northerly City boundary for the purposes of opening the road to vehicular traffic. Prior to final
24 acceptance, all identified punch-list work shall be completed to the satisfaction of the City
25 Engineer.

of the City of Carlsbad held on the 1st day of August, 2006, by the following vote:
AYES: Council Members Lewis, Hall, Kulchin, Packard, Sigafoose
