3 ENTERPRISES, INC.'S CONSTRUCTION CONTRACT ON THE
RANCHO SANTA FE ROAD FILL FAILURE AT AGUA DULCE
4 PROJECT, CITY OF CARLSBAD PROJECT NO. 1001 (FHWA
PROJECT NO. KJK-CBD-001-1); ZAMBORELLI ENTERPRISES,
5 INC.'S CONSTRUCTION CONTRACT ON LA COSTA AVE. AT
MARBELLA PROJECT, CITY OF CARLSBAD PROJECT NO.
6 1002 (FHWA PROJECT NO. KJK-CBD-002-0); ERRECA'S INC.'S
CONSTRUCTION CONTRACT ON THE LA COSTA AVE. AT
7 MARBELLA PROJECT, CITY OF CARLSBAD PROJECT NO.
1002 (FHWA PROJECT NO. KJK-CBD-002-0) ,

WHEREAS, Zamborelli Enterprises, Inc. has completed their portion of the construction
9
contract on the Rancho Santa Fe Road Fill Failure at Agua Dulce project, a portion of City of
10
Carlsbad Project No. 1001, to the City's satisfaction on August 1, 2006; and
11
WHEREAS, Zamborelli Enterprises, Inc. has completed their portion of the construction
contract on the La Costa Ave. at Marbella project, a portion of City of Carlsbad Project No. 1002,n o
to the City's satisfaction on August 1, 2006; and14
WHEREAS, Erreca's Inc. has completed their portion of the construction contract on the15
La Costa Ave. at Marbella project, a portion of City of Carlsbad Project No. 1002, to the City's16
satisfaction on August 1, 2006; and
WHEREAS, the formal project Notices of Completion have been prepared; and18
WHEREAS, all project costs have been established to date,i y
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
21 California, as follows:
22 1 • That the above recitations are true and correct.
23 2. That Zamborelli Enterprises Inc.'s construction contracts on the Rancho Santa
24 Fe Road Fill Failure at Agua Dulce project, specifically identified as a portion of Project No. 1001,
25 and on the La Costa Ave. at Marbella project, specifically identified as a portion of Project No.
26 1002, are deemed complete and are hereby accepted by the City Council of the City of Carlsbad.

3. That Erreca's Inc.'s construction contract on the La Costa Ave. at Marbella
project, specifically identified as a portion of Project No. 1002, is deemed complete and is hereby
accepted by the City Council of the City of Carlsbad.
4. The City Clerk of the City of Carlsbad is hereby authorized and directed to
5 execute and record the Notice of Completion for Zamborelli Inc.'s portion of the Rancho Santa Fe
et
Road Fill Failure at Agua Dulce project, a portion of Project No. 1001, Zamborelli Inc.'s portion of
the La Costa at Marbella project, a portion of Project No. 1002, and Erreca's Inc.'s portion of the

La Costa Ave. at Marbella project, a portion of Project No. 1002.
