A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, DECLARING AN EMERGENCY AND
APPROPRIATING AN ADDITIONAL $250,000 FROM THE
4 SEWER CAPITAL REPLACEMENT FUND TO PAY FOR THE
EMERGENCY REPAIR TO THE VISTA CARLSBAD SEWER
5 REACH 4 AT BUENA VISTA LAGOON.
6 WHEREAS, on April 1, 2007, a break was detected in the Vista-Carlsbad Sewer
7 Reach 4 at the Buena Vista Lagoon; and
3 WHEREAS, it was necessary to mobilize City staff and contractors to facilitate the
g necessary repairs; and
WHEREAS, this emergency did not permit the delay that would result from competitive
solicitation of bids and this action was necessary to respond to the emergency; and
WHEREAS, although the broken sewer line has been repaired, current estimates are

that the cost of the repair and mitigation and monitoring efforts will require up to $750,000; and
13 WHEREAS, on April 10, 2007, the City Council declared an emergency and
14
appropriated $500,000 for the repair efforts.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
16 California, as follows:
17 1. That the above recitations are true and correct.
18 2. There is a need to continue the state of local emergency declared on April 10,
19 2007 by adoption of resolution 2007-076, which need includes monitoring and mitigation efforts at
2Q the site of the sewer main break.
3. Said emergency continues to exist until declared abated by order of the City
Manager and City Council.

4. That the City Manager is hereby authorized to have repaired the sewer line.

5. The need for this continuing emergency shall be reviewed within fourteen (14)
24 days in accordance with state law.
25 6. The additional sum of $250,000 is appropriated from the Sewer Replacement
26 Capital fund to pay for this repair.

of the City of Carlsbad on the 24th day of April 2007, by the following vote:
