HomeMy WebLinkAbout2007-07-10; City Council; Resolution 2007-1651 RESOLUTION NO. 2007-165 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT FOR CONSTRUCTION OF THE 4 2007 SLURRY SEAL. PROJECT NO. 3667-14/6001-13. 5 WHEREAS, on March 6, 2007, the City Council of the City of Carlsbad approved plans 6 for construction of the 2007 Slurry Seal, Project No. 3667-14/6001-13; and 7 WHEREAS, five (5) sealed bids were received on April 24, 2007 by the City of Carlsbad o for the construction of said project; and WHEREAS, the lowest responsive and responsible bid to construct said project was9 submitted by Roy Allan Slurry Seal, in the amount of $157,412.48; and10 WHEREAS, a bid protest was submitted by American Asphalt South; and 11 WHEREAS, staff has determined that tire rubber modified slurry seal bid by Roy Allan 12 Slurry Seal is equivalent to the rubberized slurry seal bid by American Asphalt South; and 13 WHEREAS, there are sufficient funds available to complete the project; and 14 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 15 City Manager to approve change orders in the amount equal to the contingency set at the time of 16 project award. 17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 18 California, as follows: 1. That the above recitations are true and correct,i y 2. That the low bid of $157,412.48 submitted by Roy Allan Slurry Seal, for the construction of the 2007 Slurry Seal, Project No. 3667-14/6001-13, is accepted and the Mayor is 21 hereby authorized to execute a contract with Roy Allan Slurry Seal for Project No. 3667-14/ 22 6001-13. 23 3. That the City Manager is hereby authorized to approve construction change OA orders up to $31,482. 25 4. That the award of this contract is contingent upon the bidder submitting the 26 lowest responsible bid executing the required contract and submitting the required bonds and 27 insurance policies, as described in the contract, within twenty (20) days of adoption of this 28 resolution.
