RESOLUTION NO. 2007-308

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF STATION 5 STORAGE BUILDING AND
4 SKATE PARK RESTROOMS, PROJECT NO. 3688, AS
COMPLETE.

WHEREAS, the construction of the Station 5 Storage Building and Skate Park
6
Restrooms was substantially completed on November 9, 2006, all punch list work was completed
7
on March 28, 2007, and the final change order was executed on September 4, 2007; and
8
WHEREAS, the work was awarded to and begun by MSC International; and
9
WHEREAS, MSC International defaulted on the contract; and
10
WHEREAS, a takeover agreement was executed on May 19, 2006 with
MSC International's surety company, American Contractors Indemnity Company; and
WHEREAS, the work was completed to the City's satisfaction by American Contractors

Indemnity Company; and14
WHEREAS, the formal project Notice of Completion has been prepared; and

WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:1o
1 g 1. That the above recitations are true and correct.
20 2. That the Station 5 Storage Building and Skate Park Restrooms, specifically
21 identified as Project No. 3688, is deemed complete and is hereby accepted by the City Council of
22 the City of Carlsbad.
23 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
24 execute and record the Notice of Completion for Station 5 Storage Building and Skate Park
25 Restrooms, Project No. 3688.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 11th day of December, 2007, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard
NOES: None
ABSENT: None
