3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, TO APPROVE THE CITY
4 SEWER SYSTEM MANAGEMENT PLAN (SSMP) AND
AUTHORIZE STAFF TO CERTIFY THE CITY'S PROGRAM
5 TO IMPLEMENT THE SSMP AND TO SUBMIT THE
6 REPORT TO THE STATE WATER RESOURCES
CONTROL BOARD.

WHEREAS, Order No. 2006-03-DWQ (WDR), issued by the State Water Resources
9
Control Board, pertains to Waste Discharge Requirements for Sanitary Sewer Systems; and
10
WHEREAS, All federal agencies, cities, counties, municipalities and districts that own or
11
operate sanitary sewer systems greater than one mile in length or which collect and/or convey
12
wastewater to a Publicly Owned Treatment Works (POTW), are required to comply with the
13
Order; and
14
WHEREAS, the City of Carlsbad is subject to the provisions of the Order; and
15
WHEREAS, on August 7, 2007, Council adopted revisions to the City's Ordinance defining
16
responsibilities for private lateral maintenance and cleaning; and
17
WHEREAS, on November 6, 2007, Council adopted and approved the Development Plan
18
and Schedule for the Sewer System Management Plan (SSMP); and
19
WHEREAS, on October 7, 2008, Council adopted revisions to the City's Ordinance
20
pertaining to Grease Control; and
21
WHEREAS, both the SSMP and the program to implement the SSMP must be certified by
22
the City to be in compliance with the requirements of the Order and must be presented to the City
23
Council for approval. The first six elements of the SSMP with implementation deadlines in 200724
and 2008 have been certified by staff as complete; and25
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,26
California, as follows:
1. That the above recitations are true and correct. _
1 2. That the City Council approves the Sewer System Management Plan for the City
2 of Carlsbad sewer system and authorizes the Deputy Public Works Director or the Public Works
3 Manager to certify the city's program to implement the SSMP and to submit the report to the
4 Regional Water Quality Control Board by the deadline of August 2, 2009.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 21st day of July, 2009, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall and Blackburn.
NOES: Council Member Packard.
ABSENT: None.
