2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE
3 APPLICATION FOR GRANT FUNDS FROM THE HABITAT
4 CONSERVATION FUND PROGRAM (HCF)

WHEREAS, the people of the State of California have enacted the California
6
Wildlife Protection Act of 1990, which provides funds to the State of California for grants
7
to local agencies to acquire, enhance, restore or develop facilities for public recreation8
g and fish and wildlife habitat protection purposes; and
10 WHEREAS, the State Department of Parks and Recreation has been delegated
11 the responsibility for the administration of the Habitat Conservation Fund (HCF)
12 Program, setting up necessary procedures governing project application(s) under the
13 HCF Program; and
14 WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant (City of Carlsbad) to certify by resolution the approval
16
of applications(s) before submission of said applications(s) to the State; and
17
WHEREAS, as part of the grant award the City, as applicant will be required to18
enter into a subsequent contract with the State of California that assures that the City
20 will complete the construction of the trail boardwalk at Lake Calavera ("project"); and
21 WHEREAS, adequate funding is available in the Lake Calavera Trails Capital
22 Improvement Program account (account no. 3007000 9060 38661) to utilize as a match
23 for the grant application; and
24 WHEREAS, the City Council of the City of Carlsbad, California, finds it desirable
25
and in the public interest to construct a boardwalk for the Lake Calavera trail system;
26
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
27
Carlsbad, California as follows:

1 1. That the above recitations are true and correct.
2 2. Approves the filing of an application for the Habitat Conservation Fund Program.
3. Certifies that the applicant has or will have available, prior to commencement of

any work on the project included in this application, the required match and sufficient
5
funds to complete the project.

4. Certifies that the applicant has or will have sufficient funds to operate and
7
maintain the project.8
5. Certifies that the applicant has reviewed, understands, and agrees to the
10 provisions contained in the contract shown in the grant administration guide.
11 6. That the City Manager or designee has the authority to negotiate, submit, and
12 execute all related HCF Grant documents, including, without limitation, the grant
13 application, agreements, amendments and process payment requests and other
14 documents that may be necessary for the completion of the project.
15 7. The applicant agrees to comply with all applicable federal, state and local laws,
16
including applicable ordinances, rules, regulations and guidelines.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 28th day of September, 2010, by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Blackburn.
NOES: None.
ABSENT: Council Member Kulchin.
