2 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
CARLSBAD COMMENDING RESTAURANTS THAT HAVE
3 REMOVED FOIE GRAS FROM THEIR MENUS

5 WHEREAS, the City of Carlsbad has a strong commitment to protect the health
6 and welfare of all animals; and
7 WHEREAS, this commitment is shared throughout the state as legislators seek
8 to enact effective legislation to prevent the inhumane treatment of animals; and
9 WHEREAS, in 2004 the California legislature passed Cat. Health & Safety Code
10 § 25980, et. seq., which will make it illegal to sell or produce foie gras from force fed
11
birds in California, effective 2012, because of concerns for animal welfare. At least
12
fifteen countries have banned foie gras production, and only a few still produce it; and
WHEREAS, all animal protection groups recognize foie gras as inherently cruel,
15 including the Animal Protection and Rescue League (APRL), Humane Society of the
16 United States (HSUS), American Society for the Prevention of Cruelty to Animals
17 (ASPCA), and In Defense of Animals (IDA); and
18 WHEREAS, foie gras, or "fattened liver," is made by force feeding ducks or
geese large quantities of food for three to four weeks until the birds' livers have
20 expanded to over ten times their healthy size. After being force fed to this point, the
21
birds struggle to breathe and walk under their own weight; and
22
WHEREAS, the cities of San Diego, San Francisco, West Hollywood, Berkeley
23
and Solana Beach have passed resolutions commending restaurants for removing this
25 product of animal cruelty; and
26 WHEREAS, San Diego County voters approved Proposition 2, the Prevention of
27 Farm Animal Cruelty Act, by a wide margin of 65% in 2008; and
28
1 WHEREAS, in April 2008, the prestigious Pew Commission on Industrial Farm
2 Animal Production concluded a 2.5-year study of American animal agriculture with
•j unanimous findings from its 15 members, chaired by former Kansas governor John

Carlin and including, among others, former U.S. Secretary of Agriculture Dan Glickman,
5 former Dean of the Univ. of Tennessee's College of Veterinary Medicine Dr. Michael
6
Blackwell. The Commission recommended that a number of factory farm practices be
7
stopped, including force feeding ducks and geese to make foie gras; and
8
9 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
10 Carlsbad commends restaurants for removing foie gras from their menus and supports
11 California Health & Safety Code § 25980, which takes effect July 2012 to ban this cruel
12 product.

of the City of Carlsbad on the 12th day of July, 2011, by the following vote to wit:
AYES: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
