HomeMy WebLinkAbout2011-07-26; City Council; Resolution 2011-177EXHIBIT 1 1 RESOLUTION NO. 2011-177 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, TO SUMMARILY VACATE EXCESS RIGHT-OF-WAY FOR AVENIDA ENCINAS, GENERALLY 4 LOCATED BETWEEN CARLSBAD BOULEVARD AND THE RAILROAD IN THE PONTO AREA. STV 10-02 5 6 WHEREAS, a request has been made to vacate a portion of Avenida Encinas within the 7 real property of the Batiquitos Pointe project (CT 82-18); and 8 WHEREAS, this portion of Avenida Encinas was dedicated per the street alignment as 9 established by the Batiquitos Lagoon Educational Park (BLEP) master plan; and 10 WHEREAS, the Avenida Encinas street alignment was subsequently changed by the 11 Poinsettia Shores master plan; and 12 WHEREAS, the Poinsettia Shores project (CT 94-01) constructed the current alignment 13 of Avenida Encinas to its intersection with Carlsbad Boulevard; and 14 WHEREAS, the right-of-way originally dedicated by the Batiquitos Pointe project (CT 82- ^ 18) remains in place as excess right-of-way; and 16 WHEREAS, the City Engineer has determined that this excess portion of Avenida 17 Encinas right-of-way is not required for present or future street purposes; and 18 WHEREAS, the proposed vacation is consistent with the Ponto Beachfront Village Vision 19 Plan; and on WHEREAS, utility companies have no facilities within the area to be vacated; 21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 22 California, as follows: 23 1. That the above recitations are true and correct. 2. That pursuant to Division 9, Part 3, Chapter 4 of the California Street and 25 Highways Code, said portion of the original Avenida Encinas alignment more particularly described in Exhibit A, and shown for the sake of clarity in Exhibit B, be summarily vacated. 27 28 3 5 6 7 8 9 10 11 12 13 14 15 16 17 18 EXHIBIT 1 3. The City Clerk is directed to record this resolution in the Office of the County Recorder of San Diego County. 4.
