HomeMy WebLinkAbout2012-08-28; City Council; Resolution 2012-201EXHIBIT 1 1 RESOLUTION NO. 2012-201 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A MAJOR REVIEW 3 PERMIT RP 12-13 AND COASTAL DEVELOPMENT PERMIT CDP 12-04 TO ALLOW THE DEMOLITION OF ALL EXISTING 4 STRUCTURES ON SITE AND ALLOW THE CONSTRUCTION OF A TWO-STORY ATHLETIC FACILITY, PRESS BOX WITH 5 STADIUM SEATING, MAINTENANCE BUILDING, AND THE INSTALLATION OF A NEW ARTIFICIAL TURF FIELD, FIELD 6 LIGHTS AND FENCE ON PROPERTY GENERALLY LOCATED AT 2605 CARLSBAD BOULEVARD IN LAND USE DISTRICT 9 7 OF THE VILLAGE REVIEW ZONE IN LOCAL FACILITIES MANAGEMENT ZONE 1. 8 CASE NAME: ARMY & NAVY ACADEMY ATHLETIC FACILITY 9 CASE NO.: RP 12-13/CDP 12-04 10 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 11 Commission did, on July 3, 2012, hold a duly noticed public hearing as prescribed by law to 12 consider a Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04, and 1^ adopted Planning Commission Resolutions No. 6899 and 6900, recommending approval of 14 Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04; and 1^ WHEREAS, the City Council of the City of Carlsbad, on the date of this 1^ resolution, held a duly noticed public hearing to consider the recommendation of the Planning Commission and heard all persons interested in or opposed to Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04; and WHEREAS, as a result of an environmental review of the subject project conducted pursuant to the Guidelines for Implementation ofthe Califomia Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad, the project was found to be categorically exempt from the requirement for preparation of environmental documents pursuant to Section 15332 of the State CEQA Guidelines as an in-fill development project on a site of less than five acres in an urbanized area that has no habitat value and is served by adequate facilities. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 17 18 19 20 21 22 23 24 25 26 27 28 1 2. That Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04 are approved and that the findings and conditions of the Planning Commission 2 contained in Resolutions No. 6899 and 6900 on file in the City Clerk's office and incorporated herein by reference are the findings and conditions of the City Council with the addition of the 3 following condifion: 4 In the event that another school or organization is using the Army and Navy Academy's athletic facilities, the Anny and Navy Academy shall ^ provide direction and campus maps indicating the location of parking lots on campus, in order to lessen the parking impacts to the surrounding 6 neighborhood. ^ 3. That this action is final the date this resolufion is adopted by the City Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply: 8 9 10 11 18 19 21 22 23 24 25 "NOTICE TO APPLICANT" The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request y> for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the fime within which such petifion may be filed in court is extended j4 to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for 25 the preparafion of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, CA 92008. PASSED AND ADOPTED at a regular meefing of the City Council of the City of 17 Carlsbad, on the 28th day of August 2012, by the following vote, to wit: AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard.
