2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
2 CALIFORNIA, ACCEPTING BIDS AND AWARDING THE CONTRACT
TO CORA CONSTRUCTION, INC., FOR THE NORTH BATIQUITOS LIFT
4 STATION PUMP REPLACEMENT, PROJECT NO. 5517.

6 WHEREAS, the City Council of Carlsbad, California has determined it necessary,
desirable, and in the public interest to construct the North Batiquitos Lift Station Pump
Replacement, Project No. 5517; and
WHEREAS, on August 26, 2014, through the adoption of Resolution No. 2014-209, the
Carlsbad City Council approved plans and specifications, authorized the City Clerk to advertise
to receive bids forthe North Batiquitos Lift Station Pump Replacement, Project No. 5517; and
WHEREAS, nine sealed bids were received on November 13, 2014, by the City of
Carlsbad forthe construction ofthis project; and

15 WHEREAS, the apparent low bidder. Atom Engineering Construction, Inc. has not
16 provided the necessary experience required bythe language ofthe Notice Inviting Bids; and
WHEREAS, the lowest responsive and responsible bid was submitted by Cora
Constructors, Inc. in the amount of $622,845; and
WHEREAS, funds have been appropriated from the Sewer Replacement Fund and are
sufficient for the completion ofthis project; and
WHEREAS, this project is exempt from California Environmental Quality Act (CEQA)

2^ review pursuant to CEQA Guidelines section 15302(c) in that it is a replacement of an existing
24 utility system on the same site involving negligible or no expansion of capacity and a Notice of
25 Exemption was filed with the San Diego County Clerk on May 29, 2014
26 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
27 California, as follows

1 1. That the above recitations are true and correct.
2 2. That the Atom Engineering Construction, Inc. bid is a nonresponsive bid; and is

precluded from award ofa contract.
3. That the bid in the amount of $622,845 submitted by Cora Constructors, Inc., for
the construction of the North Batiquitos Lift Station Pump Replacement, Project No. 5517, is
accepted and the Mayor is hereby authorized to execute a contract with Cora Construction, Inc.
g 4. The City Manager is hereby authorized to approve construction change orders up
9 to $82,000.
5. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extensions oftime.
