3 CALIFORNIA, APPROVING A MASTER PLAN AMENDMENT TO
TRANSFER 20 RESIDENTIAL UNITS WITHIN THE ROBERTSON RANCH
4 WEST VILLAGE FROM PLANNING AREA 7 TO PLANNING AREA 8, A
SITE DEVELOPMENT PLAN AND SPECIAL USE PERMIT FOR THE
DEVELOPMENT OF 364 MULTI-FAMILY RENTAL RESIDENTIAL UNITS
g WITHIN PLANNING AREAS 7 AND 8 OF WHICH 101 ARE LOWER
INCOME AND AGE RESTRICTED, 56 ARE MODERATE INCOME
7 RESTRICTED, AND THE REMAINDER ARE MARKET RATE RENTAL
UNITS, AND A MINOR SUBDIVISION SUBDIVIDING PLANNING AREA
8 8 INTO TWO LOTS, ALL WITHIN THE ROBERTSON RANCH MASTER
PLAN ON PROPERTY LOCATED NORTH OF EL CAMINO REAL SOUTH
OF TAMARACK AVENUE AND WEST OF CANNON ROAD, IN LOCAL
FACILITIES MANAGEMENT ZONE 14.

24 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
15 Commission did, on April 1, 2015, hold a duly noticed public hearing as prescribed by law to
16 consider Master Plan Amendment MP 02-03(G), Site Development Plan SDP 14-08, Special Use
Permit SUP 14-04, and Minor Subdivision MS 14-07 and adopted Planning Commission Resolution
No. 7093, recommending approval of Master Plan Amendment MP 02-03(G), Site Development
Plan SDP 14-08, Special Use Permit SUP 14-04, and Minor Subdivision MS 14-07; and
WHEREAS, as a result of an environmental review of the subject project conducted

The City Council ofthe City of Carlsbad, California, does hereby resolve as follows:

22 pursuant to the Guidelines for Implementation of the California Environmental Quality Act and
23 the Environmental Protection Ordinance of the City of Carlsbad, the project was found to be
24 within the scope of a previously certified Environmental Impact Report EIR 03-03 for the
Robertson Ranch Master Plan.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California as follows:

1. That the above recitations are true and correct.
2. That Master Plan Amendment MP 02-03(G), Site Development Plan SDP
14-08, Special Use Permit SUP 14-04, and Minor Subdivision MS 14-07 is approved and that the
5 findings and conditions of the Planning Commission contained in Planning Commission
6 Resolution No. 7093 on file in the City Clerk's office and incorporated herein by reference are the
findings and conditions ofthe City Council.
3. That this action is final the date this resolution is adopted by the City
Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial
Review" shall apply:
"NOTICE TO APPLICANT"
23 The time within which judicial review of this decision must be sought is governed
by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of
14 Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review
must be filed in the appropriate court not later than the ninetieth day following the date on which
this decision becomes final; however, if within ten days after the decision becomes final a request
for the record is filed with a deposit in an amount sufficient to cover the estimated cost or
preparation of such record, the time within which such petition may be filed in court is extended
27 to not later than the thirtieth day following the date on which the record is either personally
delivered or mailed to the party, or his attorney of record, if he has one. A written request for
18 the preparation ofthe record ofthe proceedings shall be filed with the City Clerk, City of Carlsbad,
1200 Carlsbad Village Drive, Carlsbad, CA, 92008.

of Carlsbad on the 19th day of May 2015, by the following vote to wit:
