WHEREAS, a Special Municipal Election was held and conducted in the City of Carlsbad, California, on Tuesday, February 23, 2016; and, WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California relating to the holding of elections in cities; and, WHEREAS, on November 17, 2015 the City Council adopted Resolution No. 2015-293 ordering a Special Election to be held on Tuesday, February 23, 2016 to consider the following: "Shall Ordinance No. CS-283 of the Carlsbad City Council adopting the Agua Hedionda South Shore Specific Plan (203.4 acre east of the 1-5 freeway between the Agua Hedionda Lagoon and Cannon Road), which designates 21.6 acres of additional open space, for a total of 176.7 acres of open space for public access, preservation of natural habitat, and agriculture, along with development of 585,000 square feet of visitor-serving commercial uses on 26.7 acres be adopted?"; and, WHEREAS the proposal was known as Proposition "A" on the February 23, 2016 Special Election ballot; and, WHEREAS, the San Diego County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, and the results are received and attached as "Attachment A". That the above recitations are true and correct. 2. That the whole number of ballots cast in the city was 39,445. 3. That Proposition "A" failed to pass with 20,542 No Votes and 18,903 Yes Votes. 4. That the City Clerk's Office shall enter on the records of the City Council of the City of Carlsbad, a statement of the results of the election showing: (1) The whole number of ballots cast in the City; (2) The number of votes for and against the ballot proposition. 5. CS-295 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REPEALING ORDINANCE NO. CS-283 AND RESCINDING THE AGUA HEDIONDA SOUTH SHORE SPECIFIC PLAN, IN ITS ENTIRETY, PURSUANT TO ELECTIONS CODE SECTION 9241 WHEREAS, on August 25, 2015, the City Council received and considered the Agua Hedionda South Shore Specific Plan Initiative Measure, which had the requisite signatures to allow placement on a Special Election Ballot; and, WHEREAS, on August 25, 2015, the City Council received a presentation on the 9212 Report prepared for the Agua Hedionda South Shore Specific Plan Initiative Measure; and, WHEREAS, on August 25, 2015, the City Council considered the Agua Hedionda South Shore Specific Plan Initiative Measure and determined to adopt it without alteration as an ordinance rather than placing it on a Special Election Ballot as Ordinance No. CS-283; and, WHEREAS, a Referendum Petition, entitled "Referendum against an Ordinance Passed by the Carlsbad City Council -Ordinance No. CS-283" was circulated by Citizens for North County against the adoption of Ordinance No. CS-283 and was filed with the City Clerk on September 24, 2015; and, WHEREAS, on November 3, 2015, the City Council adopted Resolution No. 2015-276 certifying the results of the Registrar of Voters sufficiency examination of the referendum petition filed against the Agua Hedionda South Shore Specific Plan Ordinance (CS-283); and, WHEREAS, on November 17, 2015, the City Council adopted Resolution No. 2015- 293 ordering a Special Election to be held pursuant to Elections Code Sections 1410 and 9237 on Tuesday, February 23, 2016 for the purpose of submitting the following question (Measure A) to the registered voters of the City of Carlsbad: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "Shall Ordinance No. CS-283 of the Carlsbad City Council adopting the Agua Hedionda South Shore Specific Plan (203.4 acres east of the 1-5 freeway between the Agua Hedionda Lagoon and Cannon Road), which designates 21.6 acres of additional open space, for a total of 176.7 acres of open space for public access, preservation of natural habitat, and agriculture, along with development of 585,000 square feet of visitor-serving commercial uses on 26.7 acres be adopted?" WHEREAS, on March 11, 2016, the San Diego County Registrar of Voters certified the results of the Feb. 23, 2016 Special Election declaring that Measure A failed to pass with 20,542 No votes and 18,903 Yes votes. that: II II II II II II II II NOW THEREFORE, the City Council of the City of Carlsbad does ordain as follows SECTION 1.
