3 A RESOLUTION OF INTENT OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD TO VACATE A PORTION OF MADISON STREET ALLEY,
4 FROM CHESTNUT AVENUE NORTHWEST TO THE NORTHEASTERLY
PROLONGATION OF THE SOUTHEAST LINE OF LOT 14 OF MAP 775,

8 The City Council of the City of Carlsbad, California, does hereby resolve as follows:
9 WHEREAS,the City of Carlsbad as property owner of Madison Street Alley, from
10 Chestnut Avenue northwest to the northeasterly prolongation of the southeast line of Lot 14 of

Map 775; and

WHEREAS,the city engineer has determined that this portion of Madison Street
13
14 Alley, from Chestnut Avenue northwest to the northeasterly prolongation of the southeast line
15 of Lot 14 of Map 775,is not required for present or future public street or public utility purposes;
16 and
17 WHEREAS,the city engineer has determined that there are no existing city or
18
Carlsbad Municipal Water District facilities located in the portion of Madison Street Alley
19
proposed to be vacated; and
20
WHEREAS,Utility companies and pertinent city departments have been notified
21
22 of the proposed Madison Street Alley vacation and no objections have been received;
23 NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Carlsbad,
24 California,as follows:
25 1.That the above recitations are true and correct.

2.That it is Council's said intention to vacate, for public street and for public
27
utility purposes,a portion of Madison Street Alley described in Exhibit 3.

3.That the proceedings for this vacation shall be conducted in accordance with
2
the California Streets and Highways Code, Division 9, Part 3, Chapter 3.

4 4.That a public hearing shall be held at the City Council Chambers at 1200
5 Carlsbad Village Drive at 6:00 p.m.on August 23,2016 for all persons
6 interested in or objecting to said proposed vacation.
7 5.That the City Clerk is instructed to publish this resolution of intention in the
8 local newspaper and the City Engineer is instructed to post such notices along
9
the site in accordance with the California Streets and Highways Code.

11 "NOTICE TO APPLICANT"
12 The time within which judicial review of this decision must be sought is governed
13 by Code of Civil Procedure,Section 1094.6,which has been made applicable in the City of
Carlsbad by Carlsbad Municipal Code Chapter 1.16.Any petition or other paper seeking review
14 must be filed in the appropriate court not later than the ninetieth day following the date on which
this decision becomes final; however, if within ten days after the decision becomes final a request
15 for the record is filed with a deposit in an amount sufficient to cover the estimated cost or
16 preparation of such record, the time within which such petition may be filed in court is extended
to not later than the thirtieth day following the date on which the record is either personally
17 delivered or mailed to the party, or his attorney of record, if he has one.A written request for
the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad,
18 1200 Carlsbad Village Drive, Carlsbad,CA,92008.
