RESOLUTION NO. 2017-063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, TO SET A PUBLIC HEARING DATE FOR PROPOSED INCREASES
TO RECYCLING AND TRASH SERVICE RATES.
WHEREAS,the City of Carlsbad is proposing increased rates for recycling and trash services, to
be effective July 1,2017; and
WHEREAS,the California Constitution Article XIIID, Section 6(a)(2) states that local governments
must notify customers not less than 45 days in advance of a Public Hearing regarding increases in refuse
collection rates; and
WHEREAS,the California Constitution Article XIIID, Section 6(a)(2) states that if a majority of
customers submit a written protest prior to the close of the Public Hearing, then the rate increase shall
not be imposed; and
WHEREAS,Coast Waste Management,Inc.is the exclusive provider of residential and
commercial recycling and trash solid waste services in the City of Carlsbad under a contract approved
by City Council in 2012 by adopting Resolution No. 2012-033; and
WHEREAS,the contract with Coast Waste Management,Inc.provided for adjustments to
recycling and trash rates to be made as part of the city's budget adoption process for five years, through
fiscal year (FY)2016-17, as long as the rate increases met certain requirements.
NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Carlsbad, California,as
follows:
1.That the above recitations are true and correct.
2.That the City Council of the City of Carlsbad, California, sets a Public Hearing for Tuesday,
June 13, 2017, in accordance with applicable law.
3.That the City Council of the City of Carlsbad finds that this action is statutorily exempt
from the California Environmental Quality Act under Public Resources Code section
21080(b)(8)because the proposed rate increases are for the purpose of meeting
operating expenses for residential and commercial solid waste services under the
contract with Coast Waste Management,Inc.
4.That recycling and trash service rates may be adjusted and adopted annually through FY
2021-22 as part of the Master Fee schedule during the city's budget adoption process.
