A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING INCREASES TO RECYCLING AND TRASH SERVICE
RATES EFFECTIVE JULY 1, 2017.

WHEREAS, the City of Carlsbad is proposing an increase in recycling and trash collection rates,
to be effective July 1, 2017; and
WHEREAS, the California Constitution Article XIIID, Section 6(a)(2) states that local governments
must hold a Majority Protest Public Hearing and notify customers not less than 45 days in advance of
that public hearing regarding increases in recycling and trash collection rates; and
WHEREAS, the California Constitution Article XIIID, Section 6(a)(2) states that if a majority of
customers submit a written protest prior to the close of the public hearing, then the rate increase shall
not be imposed; and
WHEREAS, the written protests received represented less than a majority of affected
customers; and
WHEREAS, Coast Waste Management, Inc. is the exclusive provider of residential and
commercial recycling and trash collection services in the City of Carlsbad under a contract approved by
City Council in 2012 by adopting Resolution No. 2012-033; and
WHEREAS, the contract with Coast Waste Management, Inc. provides for adjustments to
recycling and trash collection rates to be made as part of the city's budget adoption process for five
years, through fiscal year 2016-17, as long as the rate increases met certain requirements; and
WHEREAS, on April 26, 2017, Carlsbad residents, businesses and property owners were notified
by mail of the proposed increase in recycling and trash collection rates, thereby complying with the
advance notice requirement of 45 days.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbad finds that this action is statutorily exempt
from the California Environmental Quality Act under Public Resources Code section
21080(b)(8) because the proposed rate increases are for the purpose of meeting
operating expenses for residential and commercial solid waste services under the
contract with Coast Waste Management, Inc.
3. That the City Council ofthe City of Carlsbad, California, approves the proposed increases
to recycling and trash collection rates, effective July 1, 2017.
4. That recycling and trash collection rates may be adjusted and adopted annually through
fiscal year 2021-22 as part of the master fee schedule during the city's budget adoption
process.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 13th day of June, 2017, by the following vote, to wit:
