Home My WebLink About2018-06-12; City Council; Resolution 2018-088RESOLUTION NO. 2018-088 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE MUTUTAL THREAT ZONE COOPERATIVE FIRE PROTECTION (MTZ) AGREEMENT BETWEEN THE CARLSBAD FIRE DEPARTMENT AND CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION -SAN DIEGO UNIT (CAL FIRE), AND AUTHORIZING THE FIRE CHIEF, ON BEHALF OF THE CITY, TO EXECUTE THE MTZ WITH CAL FIRE WHEREAS, the City Council of the City of Carlsbad, California has determined that the Carlsbad Fire Department maintains and operates a fire protection organization in the area generally known as Carlsbad; and WHEREAS, CAL FIRE maintains and operates a fire protection organization for providing "basic" protection to the State Responsibility Area Lands; and WHEREAS, the Mutual Threat Zone Fire Protection Agreement is a cooperative fire protection agreement between the Carlsbad Fire Department and CAL FIRE identifying Local Responsibility Area lands wherein any wild land fires occurring would constitute a direct threat to State Responsibility Area lands; and WHEREAS, the pre-designation of Mutual Threat Zone lands provides emergency responders and incident managers a more efficient and objective determination regarding jurisdictional threat assessment processes; and WHEREAS, this agreement will assist both agencies with providing prompt notification of incidents that are within, or a threat to any jurisdictional or functional responsibilities, assist with stronger coordination of initial response communications, and establish a unified command and unified resource ordering process; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. The Fire Chief is authorized, on behalf of the City of Carlsbad, to execute a Mutual Zone Threat Zone Cooperative Fire Protection Agreement with CAL FIRE (Attachment A). (SEAL) June 12, 2018 Item #7 Page 4 of 10 COOPERATIVE FIRE PROTECTION AGREEMENT Between CARLSBAD FIRE DEPARTMENT and Attachm ent A CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION (CAL FIRE) MUTUAL THREAT ZONE AGREEMENT This is a COOPERATIVE FIRE PROTECTION AGREEMENT between CITY OF CARLSBAD FIRE DEPARTMENT, hereinafter referred to as DEPARTMENT, and the STATE OF CALIFORNIA DEPARTMENT OF FORESTY AND FIRE PROTECTION (San Diego Unit), hereinafter referred to as CAL FIRE. WHEREAS, DEPARTMENT maintains and operates a fire protection organization in the area generally known as CARLSBAD; and WHEREAS, CALFIRE maintains and operates a fire protection organization for the purpose of providing 'basic" protection to the State Responsibility Area lands. NOW THEREFORE, the parties hereto mutually agree as follows: 1. DEPARTMENT and CAL FIRE agree to the Mutual Threat Zone as defined on map (Exhibit 3). 2. DEPARTMENT and CAL FIRE agree to provide timely notification of fire emergency incidents/threats to the other agency through established procedures in each agency Command/Communication Center. 3. DEPARTMENT and CAL FIRE agree to utilize the assigned VHF frequencies as defined in the Mutual Threat Zone Communications Plan (Exhibit 4) for incidents within the Mutual Threat Zone. 4. DEPARTMENT and CAL FIRE agree to a single Unified Ordering Point pre- determined as the Monte Vista Emergency Command Center (MVICC). 5. DEPARTMENT and CAL FIRE agree to utilize Unified Command based on Mutual Threat Zone jurisdictional authority or threat to Jurisdictional Authority. 6. DEPARTMENT and CAL FIRE agree that consideration of Cost Share shall be determined during extended (operation period greater than 12 hours) or major fire incidents. Such costs will be determined through a separate agreement outside of this Mutual Threat Zone agreement. June 12, 2018 Item #7 Page 5 of 10 Attachment A 7. Each party hereto shall indemnify, defend, save and hold harmless the other parties, and each of them and their respective agents, servants and employees, of and from any and all liabilities, claims, demands, debts, suits, actions and causes of action arising out of, or in any manner connected with, any act or omission of such indemnifying party hereunder or its agents, servants, or employees, done or performed pursuant to the terms and condition hereof or arising upon or within the property of such indemnifying party as herein set forth after the date of expiration of the Agreement. 8. Except as may be provided by separate written agreement between the parties, neither party shall be obligated to reimburse hereunder, or for any use of material, damage to equipment, or liability incurred which may occur in the course of rendering the firefighting assistance herein provided. 9. Nothing contained herein shall be construed as a contract under law or equity for the benefit of any third party, which may be affected by the Agreement. I 0. Nothing in this agreement shall preclude either party from exercising its right to seek recovery of costs pursuant to Health and Safety Code sections 13009 and 13009.01. 11. Either party may terminate or modify this Agreement upon ninety (90) days written notice to the other party that year. The Incident Radio Communications Plan (ICS 205) provides information on all radio frequency or trunked radio system talkgroup assignments for each operational period. The plan is a summary of information obtained about available radio frequencies or talkgroups and the assignments of those resources by the Communications Unit Leader for use by incident responders. Information from the Incident Radio Communications Plan on frequency or talkgroup assignments is normally placed on the Assignment List (ICS 204). Preparation. The ICS 205 is prepared by the Communications Unit Leader and given to the Planning Section Chief for inclusion in the Incident Action Plan. Distribution. The ICS 205 is duplicated and attached to the Incident Objectives (ICS 202) and given to all recipients as part of the Incident Action Plan (IAP). All completed original forms must be given to the Documentation Unit. Information from the ICS 205 is placed on Assignment Lists. The name of the specific trunked radio system with which the talkgroup is associated may be entered across all fields on the ICS 205 normally used for conventional channel programming information.
