RESOLUTION NO. 2020-164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, SETTING PRIORITIES FOR FILING OF REBUTTAL ARGUMENTS
REGARDING A CITY MEASURE PERTAINING TO CITY COUNCIL
COMPENSATION THAT WILL BE SUBMITTED AT THE NOVEMBER 3, 2020
GENERAL MUNICIPAL ELECTION
WHEREAS, California Elections Code Section 9285 authorizes the City Council, by majority vote,
to adopt provisions to provide for the filing of rebuttal arguments to City measures submitted at
municipal elections;
WHEREAS, a general municipal election is to be held in the City of Carlsbad, California, on
November 3, 2020, at which there will be submitted to the voters the following Measure:
MEASURE
CITY COUNCIL COMPENSATION
The people of the City of Carlsbad do ordain as follows:
Title 2, Chapter 2.04, Section 2.04.010(A) of the Carlsbad Municipal Code is
adopted to read:
The compensation of each member of the city council shall be set at
$2,052.17 per month upon the effective date of this ordinance.
Adjustments to city council compensation shall not exceed the amount
established by the San Diego Regional Consumer Price Index. Adjustments
to city council compensation must be made or permanently waived by
ordinance in January of each year. The city council is prohibited from
enacting retroactive increases for years in which a salary increase was
waived.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.

2. That pursuant to California Elections Code Section 9285, when the elections official has
selected the arguments for and against the Measure which will be printed and
distributed to the voters, the elections official shall send a copy of an argument in favor
of the proposition to the authors of any argument against the Measure and a copy of an
argument against the Measure to the authors of any argument in favor of the Measure
immediately upon receiving the arguments. The author or a majority of the authors of
an argument relating to a City Measure may prepare and submit a rebuttal argument
not exceeding 250 words or may authorize in writing any other person or persons to
prepare, submit, or sign the rebuttal argument. A rebuttal argument may not be signed
by more than five authors. The rebuttal arguments shall be filed with the City Clerk,
signed, with the printed name(s) and signature(s) of the author(s) submitting it, or if
submitted on behalf of an organization, the name of the organization, and the printed
name and signature of at least one of its principal officers, not more than 10 days after
the final date for filing direct arguments. The rebuttal arguments shall be accompanied
by the Form of Statement to be Filed by Author(s) of Argument. Rebuttal arguments
shall be printed in the same manner as the direct arguments. Each rebuttal argument
shall immediately follow the direct argument which it seeks to rebut.
3. That the above provisions shall apply only to the election to be held on November 3,
2020.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 28th day of July, 2020, by the following vote, to wit:
AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
NAYS: None.
