A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING APPROPRIATION OF ADDITIONAL FUNDS IN AN
AMOUNT OF $136,000 FROM THE GAS TAX FUND FOR THE PALOMAR
AIRPORT ROAD WIDENING PROJECT, CAPITAL IMPROVEMENT PROGRAM
(CIP) PROJECT NOS. 6043 AND 6044 (PROJECT) AND INCREASING THE
CONSTRUCTION CONTINGENCY FOR THE PROJECT BY $60,000
WHEREAS, on July 23, 2019, the City Council of the City of Carlsbad, California adopted
Resolution No. 2019-128, awarding a $741,463.10 contract to Just Construction, Inc. (Contractor), for
construction of the Palomar Airport Road Widening Improvements at Paseo Del Norte, CIP Project Nos.
6043 and 6044 (Project); with an additional construction contingency of $135,000; and
WHEREAS, in March 2020, the City of Carlsbad postponed start of construction; and
WHEREAS, the Contractor submitted a change order request in the amount of $132,121, of
which staff has determined merit for reimbursement of costs in the amount of $42,381.27 regarding
delay in start of the work; and
WHEREAS, the Project has been further impacted by unforeseen conditions resulting in changes
to the scope of work and project schedule delays in the amount of $17,618.73; and
WHEREAS, staff requests that the Project's construction contingency be increased by $60,000
to cover the cost of delaying the start of work and changes in the scope of work; and
WHEREAS, staff has determined an additional $80,000 in funding is required to provide the
necessary services for construction management, inspection, material testing, engineering and staff
support through an extended construction duration; and
WHEREAS, sufficient Gas Tax funds in the amount of $136,000 are available to complete the
Project; and
WHEREAS, the city planner has determined that the Project is exempt from the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) - minor alteration of
existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no
expansion, and none of the exceptions described in CEQA Section 15300.2 are applicable to this project.
A Notice of Exemption was filed in the office of the San Diego County Clerk on Feb. 20, 2018 for a 30-
day public review.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:

1. That the above recitations are true and correct.
2. That the deputy city manager, administrative services is authorized and directed to
appropriate funds from the Gas Tax Fund in the amount of $40,000 and $96,000 to the Palomar Airport
Road and Paseo Del Norte Left-Turn Lane Project (CIP Project No. 6043) and the Palomar Airport Road
and Paseo Del Norte Right-Turn Lane Project (CIP Project No. 6044), respectively, for a total
appropriation of $136,000 in support of construction of the Project.
3. That the city manager or designee is hereby authorized to approve construction change
orders for an additional amount of $60,000 for a total not-to-exceed amount of $195,000.
4. That the city planner has determined that the Project is exempt from the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) - minor alteration of
existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no
expansion, and none of the exceptions described in CEQA Section 15300.2 are applicable to this project.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 20th day of October, 2020, by the following vote, to wit:
