RESOLUTION
A RESOLUTION REQUESTING
CABLE TELEVISION CHANNEL RESERVATIONS
FOR PUBLIC SCHOOLS
WHEREAS all or part of the Palomar Community College School District
lies within the jurisdiction of the City of Carlsbad.
being the granting authority for cable television (CATV) franchises, and
WHEREAS the Cable Television (CATV) industry is making an increased effort
to install cable television systems in communities throughout San Diego
County as well as the entire country, and
WHEREAS the potential of expanded cable television systems will provide
high quality multi-channel signals beyond the current broadcast spectrum
and opens possibilities for the creation of an Educational Resources Access
System in education and government, including facilities for instructional
television, computer assisted instruction, computer services, and the
transmission of instruction in verbal, written, or pictorial form, and
WHEREAS large corporations are being attracted by the potential economic
benefits and through merger, acquisition and/or establishment of new
franchises, and
WHEREAS local school systems recognize the urgency to share in the use of
this public facility based upon proven successes of instructional television
programming, and

WHEREAS the National Cable Television Association (NCTA) in its position
paper, dated April 19&9, endorsed the policy as follows: "To this end,
NCTA and the cable television industry endorse a policy of supporting the
efforts of the National Education Association, the Joint Council on
Educational Telecommunications (JCET) and the California Public School
Instructional Television Committee, and other organizations concerned with
future planning for the nation's school systems," and
WHEREAS in implementing the same position paper the NCTA stated: "Further,
it is the intention of NCTA and the cable television industry to support a
plan in principle whereby cable systems allot standard and non-standard
channels of proposed and existing cable systems to school districts and
other educational bodies to accomplish the goals of television instruction;
and generally to provide whatever assistance necessary to help alleviate
over-crowded classroom conditions, provide in-home instructional assistance,
and to serve in other ways for the greater efficiency and effectiveness of
public education," and
WHEREAS in the same position paper the NCTA supports the organizations
which have set a traditional 20 per cent channel system capacity for
education, and
WHEREAS the schools of San Diego County have cooperated for the past five
years to provide an effective television service to the schools of our
communities,

NOW, THEREFORE, HE IT RESOLVED that the San Diego County Board of
Supervisors and the city councils of the thirteen (13) municipalities
take steps to involve the San Diego County Board of Education in all
negotiations for franchise requests by cable television organizations,
and
BE IT FURTHER RESOLVED that, upon notice of intent by a cable television
company to seek a franchise, immediate notice be forwarded to the District
Superintendent of the Palomar Community College School District and the
County Superintendent of Schools to insure adequate representation during
negotiations, and
BE IT FURTHER RESOLVED that each franchise considered shall provide that
the grantee install into each elementary and secondary public school
building and community college within the cable service area cable
connections sufficient to enable each building to receive all programs
transmitted over the system, and
BE IT FURTHER RESOLVED that each franchise considered shall incorporate
a percentage of cable system channel capacity commensurate with
educational needs and potential. The percentage specified in the franchise
shall be based upon a traditionally established percentage of channels
and/or facilities reserved especially for education. Since the inception
of radio and television, this percentage has been not less than (20)
per cent.
BE IT FURTHER RESOLVED that the Palomar Community College School District
hereby requests that any franchise for cable television granted by the
Board of Supervisors, County of San Diego, and the Cities of Carlsbad,
Escondido, Oceanside, San Diego, Vista, and San Marcos
in which said school district lies all or in part designate in the franchise
the San Diego County Board of Education and their representative, the County
Superintendent of Schools, as the trustee of the cable television allocations
for the purpose of assuring fair and equitable distribution of channel space
resource among the various school districts involved.
