DESIGN REVIEW BOARD RESOLUTION NO. 062
A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF
CARLSBAD, CALIFORNIA, DENYING A REDEVELOPMENT PERMIT TO
CONSTRUCT FIVE TENNIS COURTS, A CLUBHOUSE AND PARKING LOT
ON PROPERTY GENERALLY LOCATED ON THE RIGHT-OF-WAY OF THE
WEST SIDE OF THE AT&SF RAILROAD TRACKS BETWEEN OAK AND
PINE AVENUES IN DOWNTOWN CARLSBAD.
APPLICANT: CARLSBAD INN, LTD.
CASE NO.: RP 85-18
WHEREAS8 a verified application has been filed with the
City of Carlsbad and referred to the Design Review Board; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code,
the Design Review Board did, on the 5th day of February, 1986, hold
a duly noticed public hearing to consider said application on
property described as:
(See attached Exhibit "X" )
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any8 of all persons desiring to be
heard, said Board considered all factors relating to RP 85-18.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review
Board of the City of Carlsbad as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Board DENIES RP 85-18, based on the following findings:
Findings :
1) The proposed project is not in conformance with the goals and
objectives of Sub-area 4 of the Village Redevelopment zone.

The proposed project could set a precedent for commercial
development in the railroad right-of-way that is premature in
light of the completion of a beach area land use study.
The propose use is inappropriate because the entire railroad
right-of-way will be looked at in terms of possible future uses in an upcoming beach area land use study.
At the recent request of City Council, the beach area traffic study will analyze the possibility of extending Washington Street from Elm Avenue to Tamarack Avenue. Approval of this project would preclude such extension if it is deemed a feasible solution to traffic circulation problems.
