DESIGN REMEW BOARD RESOLUTION NO. 210
A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE
CITY OF CARLSBAD, CALIFORNIA APPROVING A MINOR
REDEVELOPMENT PERMIT TO ALLOW A 1.64 ACRE LUMBER
YARD ON PROPERTY GENERALLY LOCATED IN THE
RAILROAD RIGHT-OF-WAY WEST OF STATE STREET AND
SOUTHEAST OF CARLSBAD BOULEVARD IN SUB-AREA 3 OF
THE VILLAGE REDEVELOPMENT ZONE.
CASE NAME: BAUER LUMBER YARD RELOCATION
CASE NO: RP 94-01
WHEREAS, a verified application has been filed with the City of Carlsbad and
referred to the Design Review Board; and
WHEREAS, said verified application constitutes a request as provided by Title
21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Design
Review Board did, on the 2nd day of March, 1994, hold a duly noticed hearing to consider
said application on property described as:
Portion of Parcel 17 of S.B.E. Map No. 804-37-8K, in the City
of Carlsbad, County of San Diego, State of California.
WHEREAS, at said hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Design Review Board considered
all factors relating to RP 94-01.
NOW, THEREFORE, BE tT HEREBY RESOLVED by the Design Review Board
as follows:

That the foregoing recitations are true and correct.
That based on the evidence presented at the hearing, the Design Review
Board APPROVES RP 94-01, based on the following findings and subject to
the following conditions:

1. The proposed lumber yard is consistent with the various goals and objectives of the
General Plan as evidenced by the provision of a regional service use, adequate
landscaping, parking and site design.

The proposed lumber yard is in accordance with the Carlsbad Vige Area
Redevelopment Plan and Village Design Manual because it improveS the visual
aesthetics of the area, and provides adequate building scale, landscaping, parking
and signage.
The proposed lumber yard is in accordance with the applicable provisions of the
Carlsbad Mdapal Code as demonstrated by the maintenance of compatibilitywith
surrounding uses, and the provision of parking, landscaping and appropriate
signage.

Approval is granted for RP 94-01, as shown on Exhibits "A" - "B", dated March 2,
1994, incorporated by reference and on file in the Planning Department.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
The developer shall provide the City with a reproducible 24" x 36", mylar copy of
the site plan as approved by the Design Review Board. The site plan shall reflect
the conditions of approval by the City. The plan copy shall be submitted to the
Planning Director and approved prior to building permit approval.
Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance, the Vige Design Manual, and all other applicable City ordinances in
effect at time of building permit issuance.
Approval of RP 94-01 is subject to approval of CDP 94-01. AU conditions of CDP
94-01, Design Review Board Resolution No. 211, dated March 2,1994, on file in
the Planning Department, are incorporated herein by reference.
Approval of RP 94-01 is granted on the condition that the lumber yard ody serve
as a storage and pick-up area for customers and no retail operations be conducted
on the site.
This minor Redevelopment Permit is granted for a period of five (5) years, with an
expiration date of March 2, 1999. All operations must cease on or before the
expiration date unless an extension has been granted by the Design Review Board.
This minor Redevelopment Permit shall be reviewed by the Planning Director and
Housing and Redevelopment Director on a yearly basis to detennine if all conditions
of this permit have been met and that the use does not have a significant
detrimental impact on surrounding properties or the public health and welfare. If
the Planning Director and/or Housing and Redevelopment Director determines that
the use has such significant adverse impacts, the Planning Director and/or Housing
and Redevelopment Director shall recommend that the Design Review Board, after
providing the permittee the opportunity to be heard, add additional conditions to
mitigate the significant adverse impacts. This permit may be revoked at any time
after a public hearing, if it is found that the use has a significant detrimental affect
on surrounding land uses and the public's health and welfare, or the conditions

imposed herein have not been met. This permit may be extended for a reasonable
period of time not to exceed five (5) years upon written application of the permittee
made no less than 90 days prior to the expiration date. In granting such extension,
the Design Review Board shall find that no substantial adverse affect on surrounding
land uses or the public’s health and welfare will result because of the continuation
of the permitted use. If a substantial adverse affect on surrounding land uses or the
public’s health and welfare is found, the extension shall be considered as an original
application for a conditional use permit. There is no limit to the number of
extensions the Design Review Board may grant.
This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval.
All additional structures shall require a building permit from the Carlsbad Building
Department and meet Uniform Building Code and klsbad Municipal Code
requirements as pennanent buildings (new restroom, outdoor storage building, etc.)
Any hnprovements or modification to the existing bdding(s) requires a tenant
improvement building permit. All signage requires a sign permit from the Building
Department.
Trash receptacle areas shall be screened by a six-foot high solid fence and shall be
located within the lum-d, to the satisfaction of the Planning Director.
Enclosure shall be of similar colors and/or materials to the project to the satisfaction
of the Planning Director.
All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and
streets, in substance as provided in Building Department Policy No. 80-6, to the
satisfaction of the Directors of Planning and Building.
All visitor parking spaces shall be striped a different color than the assigned
employee parking spaces and shall be clearly marked as may be approved by the
Planning Director.
An exterior lighting plan including parking areas shall be submitted for Planning
Director approval. All lighting shall be designed to reflect downward and avoid any
impacts on adjacent property.
AI1 landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
Any signs proposed for this development shall at a minimum be designed in
conformance with the City‘s Sign Ordinance and shall require review and approval
of the Planning Director prior to installation of such signs. A comprehensive sign
program indicating the size and location of all identity and directional signage shall
be submitted to and approved by the Planning Director prior to the installation of
any signs.

Building identification and/or addresses shall be placed on all new and existing
buildings so as to be plainly visible from the street or access road; color of
identification and/or addresses shall contrast to their background color.
Prior to the issuance of any further City permit, secondary access to the alley must
be provided to the satisfaction of the City Engineer and the Fire Marshal in
compliance with the City's cul-de-sac standard.
Prior to the issuance of any further City permits, the existbg encroachments into
the alley right-of-way shall be removed and the project shall be redesigned to
remove the proposed parking shown in the alley right-of-way, to the satisfaction of
the City Engineer and Planning Director.
Prior to the issuance of any further City permits, the applicant shall submit and
receive approval of a site plan to the Fire Department which depicts the location of
all existing and proposed fire hydrants. Additional fire hydrants may be required
and must be installed prior to the storage of materials onsite, to the satisfaction of
the Fire Marshal.
Since the proposed site is within the transportation corridor, the North County
Transit District could declare a need of this property. Should this occur, the
Conditional Use Permit becomes invalid.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Design
Review Board of the City of Carlsbad, California, held on the 2nd day of March, 1994 by
the following vote, to wit:
AYES: Chairperson Savary, Board Members: Noble & Rowlett.
NOES: None.
ABSENT: Board Members: Gonzales & Erwin
ABSTAIN: None.
